B. The subdivision plat is in compliance Iwith Section 3.3.1(B) Lots in that: 1) Each of the three lots on the Replat of Lot M1 have direct vehicular access to a public street (Annelise Way), and the side lot lines are substantially at right angles or radial to the street line. Each of the six lots on the Replat of Lot M5 have direct vehicular access to a public street (Chase Drive), and the side lot lines are substantially at right angles or radial to the street line. 2) The general layout of lots, roads, driveways, utilities, drainage facilities and other services within the proposed development have been previously established in Rigden Farm, Filing Six. C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) An applicant shall be required to dedicate rights -of way for public streets, drainage easements and utility easements as needed to serve the area being platted. The rights -of -way for William Neal Parkway, Chase Drive, and Annelise Way were previously dedicated by the Rigden Farm, Filing Six subdivision plat and the drainage and utility easements necessary to serve these lots will be dedicated with the Rigden Farm, Filing Six, Replats of Lot M1 & M5 plats, if approved and filed. 2) Reservation of sites for flood control, open space and other municipal uses shall be made in accordance with the requirements of this Land Use Code. This criteria is not applicable to the Rigden Farm, Filing Six, Replats of Lot M1 & M5 - PDP request. 5. Findings of Fact/Conclusion: A. The Rigden Farm, Filing Six, Replat of Lots M1 & M5 - PDP meets the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. B. The Rigden Farm, Filing Six, Replat of Lots M1 & M5 - PDP meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. Purpose of the Subdivision: M5 — Project Development Plan, The purpose for the replatting of Lot M1 of Rigden Farm, Filing Six is to create three legally subdivided lots on a property that presently is one lot in the subdivision. The property is currently an undeveloped 12,470 square foot lot. The replat will provide a separate lot for each proposed single-family detached dwelling unit. The new lots would be 4,559 square feet, 3,818 square feet, and 4,093 square feet in size. Staff has determined that there is no detriment to the development plan associated with the platting of three lots. The purpose for the replatting of Lot M5 of Rigden Farm, Filing Six is to create six legally subdivided lots on a property thati presently is one lot in the subdivision. The property is currently an undeveloped 29,196 square foot lot. The replat will provide a separate lot for each proposed two-family dwelling unit. The new lots would be 3,469 square feet, 3,!966 square feet, 4,476 square feet, 4,985 square feet, 5,495 square feet, and 6805 square feet in size. Staff has determined that there is no detriment to the development plan associated with the platting of six lots. 3. Article 2 - Administration: The Replats of Lot M1 and M5 of Rigden Farm, Filing Six - PDP comply with the applicable requirements of the LUC, specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. 4. Article 3 - General Development Standards: The Replats of Lot M1 and M5 of Rigden Farm, Filing Six - PDP comply with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. A. The subdivision plats are in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plats will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) No building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the Rigden Farm, Filing Six, Replat of Lots M1 & M5 — Project Development Plan, #56-98AF October 13, 2005 Administrative Hearing Page 2 separately through the Minor Amendment process. The total number of dwelling units will not change on this property, which is located at the northeast corner of Chase Drive and ,William Neal Parkway. The properties are in the LMN — Low De District.
