County Road 38E, Fort Collins, Colorado 80526 Planning Departrnent File Nos.: 5798 and 5798A The undersigned Applicant, Bret Larimer, hereby withdrawals the above referenced petitions for annexation into the City of Fort Collins, referred to as the Wykoff — Larimer Annexation, Part 1 and Part 2 Bret Larimer, Applicant Cc: Bob Blanchard, Director of Planning Mr. John Fischbach, City Manager Page 2 May 3, 1999 Mr. Larimer has advised us that as soon as further studies can be conducted concerning viable zoning classification in the City, he will request that we again petition the City for annexation. It is our understanding that Mr. Larimer submitted a request on April 26, 1999, that the petitions likewise be withdrawn. A copy of his letter is attached for your convenience. Sincerely, Rex E. WYKOFF 2916 West County Road 38E Fort Collins, CO 80526 May 3, 1999 Mr. John Fischbach City Manager City of Fort Collins RE: WYKOFF — LARUv4ER ANNEXATION & ZONING, FIRST, #57-98 WYKOFF — LARRvlER ANNEXATION & ZONING, SECOND, #57-98 A Dear Mr. Fischbach: We are the owners of the property described in the above -referenced applications for annexation to the City of Fort Collins. The purpose of this letter is to withdraw the applications for annexation. We respectfully request that the City Council give its favorable consideration to this request. To assist in consideration of this request, we provide the following information. The original application was signed by us for a gross acreage of 20.667 acres on October 30, 1998. It is our understanding that Mr. Larimer was advised by Bob Blanchard that the 20.667 acres described in the petition did not meet the requirements of § 31-12-104(1)(a), C.R.S. (less than one -sixth of the perimeter of the area proposed to be annexed was contiguous to the City of Fort Collins). We are advised that Mr. Larimer, the president of Bret Larimer, Ltd., to whom we are under contract in regard to the property, then prepared two new petitions, file #'s 57-98 and 57-98 A, which were filed with the City of Fort Collins representing 6.69 acres and 14.47 acres, respectively. We did not execute these petitions as required by § 31-12-107(1)(c)(V), C.RS., and thus the petitions were not in substantial compliance as required by subsection 1(g). Notwithstanding these technical irregularities, we sincerely express our desire that the petitions for annexation be withdrawn. We would further like to advise you that our present intentions are to continue the use of the property as it is currently used for pastoral purposes.
