If for some reason the light fixture ceases to become the principal use, then the antennas would have to be removed as a zoning violation. Therefore, please add the following note to the plans: "Approval of the Wireless Telecommunications Equipment, as a co - location on an existing ballfield light fixture, is conditioned on the fact of the ballfield light fixtures remaining as a principal use. If the ballfield light fixtures are to be removed by Poudre School District, whether voluntarily or by court order or for any reason, then the Wireless Telecommunications Equipment shall be removed as well." 5. Is it necessary to provide ownership signature blocks for two owners? The Nextel application indicates that only one signature is needed by Poudre School District. 6. Please provide an address line for the Notary 7. Please change the City signature approval block and use the enclosed as an example. 8. In the lower right corner, please label the sheets as sheet one of two and sheet two of two. 9. Please provide one 81/2 x 11 photo (not xerox) reduction of the revised plans by no later than Wednesday, April 5th. This is also called a -photo- mechanical transfer. 10. Please provide ten sets (folded) of the plans by no later than Monday, April 10th 11. Do not send any signed plans at this time. After the Planning and Zoning Board approval, we will ask for signed mylars of the plans. This concludes Staff comments at this time. Commr 'y Planning and Environmental -vices Current Planning City of Fort Collins March 30, 2000 Ms. Lisa Morian Cellular Realty Advisors 4301 East Colfax Avenue, Room 314 Denver, CO 80220 Dear Lisa: As we have discussed over the phone, the request for wireless telecommunications equipment at Poudre High School is scheduled for consideration by the City of Fort Collins Planning and Zoning Board on April 20, 2000. 1 have now had a chance to review the plans and offer the following comments: 1. Please add "Wireless Telecommunications Equipment' to the site name after "Poudre High School' at the top of the sheet. 2. On the Lot Plan, it is not clearly indicated that the U.S. West Wireless is actually co -locating on the left field pole behind the third base dugout. The plans should specifically -call out the existing pole -and that this pole is the one to be used by U.S. West Wireless. Please clarify that the right field pole behind the first base dugout is being used by Nextel. 3. Please add the following note to the plans: "No wireless telecommunication equipment owner, lessee or employee thereof shall act to exclude or attempt to exclude any other wireless telecommunication provider from using the same structure (light fixture). Wireless telecommunication equipment owners, lessees or employees thereof shall cooperate in good faith to achieve co -location of wireless telecommunication equipment with other wireless telecommunication providers." 4. The high school is located in residential zone where monopoles are not allowed. The request is being processed as a co -location of an accessory use on an existing light fixture which acts as the principal use. Under the threat of legal action, Poudre School District negotiated with the surrounding property owners to limit the number of night games per year 281 North College Avenue • PO.
