Fischbach City Manager JFF/ah cc: Greg Byme, Community Planning and Environmental Services Director City Manager t City of Fort Collins December 21, 1999 Mr. James Becker Turning Point Executive Director 1644 South College Avenue Fort Collins, CO 80525 Dear Mr. Becker: I wanted to write to you with regards to the building plans that you are trying to get approved for the renovation of a fraternity house located at 801 South Shields to house approximately 36 girls in residential care, a "day treatment" alternative school for up to 24 youths and administrative offices. I apologize that my letter has taken so long to gei to you, but we did have other things to check on and I wanted to make sure that we were proper in what we were telling you. After receiving a copy of the E-mail from you addressed to the Mayor, we distributed it to the staff involved with,Development Review asking for comments. Responses were received from the Project Planner, Troy Jones, and Building Inspection, Mike Gebo, Inspection Services Supervisor. Without specifics, it is difficult to respond to allegations that the staff made "discretionary decisions" that resulted in changes during the review process. However, our understanding of those involved is that this did not occur. Specifically, the allegations that the staff demanded changes to the exterior is incorrect. Fagade changes were never required by staff. Our understanding is that you wanted to make some exterior changes that were determined to be structural in nature that would definitely have affected the cost. Unfortunately, some requirements were discovered in the Review Process resulting in extra steps being required before a building permit could be approved. Originally, it had been assumed the lot was a legally subdivided lot so that you were informed a subdivision would not be necessary. However, it was later discovered that the lot had never been legally platted. The Land Use Code requires that property be part of a an official subdivision before a building permit can be issued. Rather than review in detail the specific allegations that were made, I would like to make an offer to meet with you to see if I can expedite any approvals that may be necessary.
