That the developer make good faith efforts and negotiate with the ditch company getting consent to plant grasses and shrubs it feels acceptable. 2. Developer report back in writing to the Fort Collins Dept. of Natural Resources what the results of its negotiations are. Note: Jon also agreed to use the company's best efforts to encourage concerned neighbors to set up, manage and run a non-profit corporation for the purpose of holding title to the tract. 8/3/00 The same date as above — Jon wrote memo to Kim suggesting a little different language be used in the development agreement. Jon reiterated that he was disappointed that Turner had cooled off on gathering the dozen or so neighbors as suggested to entertain the idea of creating and managing a no - profit corporation for a privately owned mini -open space wildlife area. 8/18/00 Tom Shoemaker called Jon wanting to talk about P & Z's requirement on Promontory to see if something additional could be done about the vegetation between the backs of the buildings and the ditch. Tom made several suggestions about what should be planted before Jon meets with the ditch company. He wanted it to show on the final plans whether shrubs, unmowed grasses, etc. be allowed rather than "something to be resolved as part of the development agreement". 8/31/00 Pam Stevens, Trees, Water and People — 484-3678 Responding to fox article in the Coloradoan. Would like more information. Kaye called her and talked about what we knew. Followed up by sending her copy of the PUD (Somerset, Tract A)plus copy of Larimer County real estate tax information. Gave her Sally Bridges number at the Coloradoan. 9/5/00 Pam Stevens, Trees, Water and People called to say her group had taken a look at the tract. Said "It's awful weedy!!" Asked which of the trees does the fox family reside in. Kaye told her the tree at the corner of JFK and Troutman. (She was much more interested in the cluster of trees to the east.) Kaye sent her a copy of our PUD. She has not responded since this date — 9/5/00. 10/4/00 Jon met with John Strachan and John Moen, Larimer County Canal #2 on site to discuss vegetation. Wildlife Corridor Discussions Chronological List of Contacts with Interested Parties 6/2/00 Jon Prouty faxed memo to Tom Shoemaker asking for clarification of Land Use Code language on wildlife corridor language — giving Natural Resources opportunity to work with the appropriate other city departments to resolve questions. 6/6/00 Nancy Howard, Dist. Wildlife Manager of DOW wrote letter to Kim Kreimeyer at City Natural Resources Dept — "does not consider this to be a wildlife movement corridor at this time" 6/30/00 Memo to Planning and Zoning Board from Tom Shoemaker, Karen Manci, & Kim Kreimeyer "Our records and observations in the area do not indicate any extensive, ongoing use of the canal as a wildlife movement corridor' 7/31/00 At Jon's request, Kaye called Jo Ella Turner (the fox lady who spoke at P & Z meeting about her concern, and neighbors, about the foxes). I Kaye was able to state Jon's proposal to contact the owner of the tract of land, assist her in organizing her group of neighbors, and ask basically what she would like to see done here. What was gathered from her comments were that all they wanted to see here was that there be no passage way along either side of the ditch which would allow people, dogs, bicycles, etc. and placement of signs indicating this. She said she did not know the names of all the people she talked with so doubted that she could get them together for a meeting to discuss "taking over the real estate and / or maintenance of same". It was left that if she could get enough interested people to make a commitment to meet with Jon that she would call back. 8/2/00 Jon faxed memo to Tom Shoemaker stating we followed up with Jo Ella Turner and made offer to contact the owner of Tract A (Somerset). Jon let Tom know that he would not be pursuing the acquisition of the lot from Somerset unless Tumer called us back to say she had obtained enough people who would be interested in meeting with Jon about taking over the tract. 8/2/00 Kim Kreimeyer called Jon about the statement "Jon made at the P & Z meeting about organizing the fox people". She said Marc Virata had asked her to consider starting on the language for the development agreement and that this issue needed to be resolved before the language could be done. She also stated that after discussing the acquisition of the Tract that Tom said the "City would not want the area to be a City -owned natural area". completed and closed. Notwithstanding this fact, Tom, if you have any new ideas about a viable natural resource -open space use for this property, I would, of course, be happy to assist you in whatever way I can. Box 580 Fort Collins, CO 80522 Re: Promontory / Approximate One -Acre Outlot To South (Under Separate Ownership) / Wildlife Considerations Dear Tom: I wanted to report to you what we have done to follow up my commitment to the P&Z Board and concerned neighbors a) to acquire this approximate one -acre outlot south of our property, south of the Post Office and north of Troutman (between JFK and Boardwalk) for open space and wildlife habitat purposes, and b) to set up a non-profit organization for the ownership and management of same. All the foregoing was - subject, however, to securing evidence of the neighbors substantial interest in owning and managing this property through such non-profit corporation for the purposes described. See our itemized list of our efforts in this regard attached. Accordingly, Tom, I have to conclude that the idea of privately maintaining this property through a non-profit corporation as a wildlife habitat is a) not of sufficient interest for the neighbors to come forward in the minimal numbers necessary to assure that the efforts we would make to acquire the property and set up a non-profit corporation would not be for naught and/or b) this idea, while romantic, may simply not be feasible or realistic. This conclusion furthermore is supported, I think, by the opinions indicated explicitly and implicitly by the two enclosed letters, one from the Colorado Department of Wildlife and the other a letter from me to the Larimer County Canal #2 following up my meeting with them.
