Collins, CO 80525 Re: North Flats — Request for permission to project removable stairways into a utility easement Dear Sirs, Millhaus, Incorporated is developing a residential project known as North Flats. This project is located in Old Town North Subdivision, north of Vine Drive and east of College Avenue in Fort Collins. This project consists of eight buildings each containing 5 residential units which are to be placed on lots within Old Town North that have previously had the infrastructure constructed. Specifically, the lots are M-10 through M-17 of Block 3, Lots M-9 through M-16 of Block 4, Lots M- 42 through M49 of Block 7, Lots M-22 through M-29 of Block 8 together with Tracts T-AA, T-N, T- 0. T-UU and T-VV. Please refer to the attached coppies of a site plan and the proposed plat for the project. As these lots are very restrictive in size it has become necessary to project a portion of the stairways serving the upper level units into the utility easement at the front of the units and therefore it is requested that Xcel grant permission to allow these stairways to make such an encroachment into the easement. The easements in question contain an Xcel gas line and with this in mind it is understood that Xcel may need access to this gas line at some point in time. To accommodate this, the stairways will be constructed of steel stingers, treads and railings assembled together as a single unit that will be attached to the bulking with bolted connections. The stairway units would then be able to be easily disconnected from the building should the event arise that Xcel would need to gain access to the easement in the positrons where the stairways are located. If you find this request to be acceptable, could you please indicate so in writing and provide information as to the appropriate format of a proper legal agreement to address this situation?
