Staff has reviewed your submittal for FOSSIL LAKE ANNEXATION #1 - TYPE II (LUC), #33-
01, and we offer the following comments:

Although the landowners in the area are subject to a covenant running with the land
which affirmatively consents to the annexation of the Property to the City, the State
Constitutional requirement that more than 50% of the landowners of the area to be
annexed must sign the petition is not being satisfied.

The opening paragraph on all three petitions refer to "Fossil Lake PUD" as the area of
the annexation. The petition for annexation #1 needs to refer to itself as "Fossil Lake
PUD Annexation No. 1. "
