Subject: Fossil Lake - 4th Filing
Hi Tony,
I gather you are involved in reviewing the proposed Fossil Lake 4th Filing - and as a resident of Fossil
Lake I wanted to raise some concerns about the nature of this proposed development by Everitt and KEM.
It is very clear to me that the development breaks the terms and conditions outlined in the development
agreement between the original developer and Larimer County. This agreement makes it clear that:
"The land uses approved for the North Parcel consist of 428 single family lots, 58 patio/townhouse units
on Trcts B and C, and a variable use on tract A of neighborhood service or commercial uses such as
daycare, church, office, photo studio etc. In the event one or more of these types of neighborhood service
or commercial uses occurs on the other properties withing a 3/8 mile radius of tract A, then the Deeloper
shall be permitted to have a maximum of 80 multi -family dwelling units on Tract A"
I gather that Everitt and KEM are arguing that the Fossil Lake PUD community building (sic) and pool
complex qualifies as a "neighborhood service" - but this is clearly not the case:
- The Fossil Lake Clubhouse is a private clubhouse open only to residents on a fee paying basis - for
private use only.
- The Pool complex is a private clubhouse facility - only open to families willing to pay approx. per year
$300 per family.
- There is a small play area within the grounds of the Clubhouse - but this is only accessible to those who
pay pool dues.
- The pool and play are both fenced off from the rest of the neighborhood and neither are available for
public, neighborhood use.
- The pool and play area are both only available during the summer for 3 approximately months.
Given all of the above - common sense tells me that the Fossil Lake Clubhouse in no way qualifies as a
"neighborhood service".
I'd appreciate hearing from you - on the City of Fort Collins position on the legal basis of the Everitt and
KEM claim - that the Fossil Lake Clubhouse qualifies as a "neighborhood service".
