What would they say today? Clearly an attorney must be needed here. There must be one in this neighborhood willing to keep their neighborhood safe. I will try to find one Mr. Jones, because you are not here for us. I'm certain the future residents would not appreciate the news of these plans? We are free to have free speech in our neighborhood are we not? Free to warn the new potential residents that they will soon be living with no doubt a lot of renters. This is no better than living on Horsetooth and Manhattan. You may have no other agenda but to identify to us what you believe the rules to be, but maybe we can get the attention of the very wealthy Everitt and Kern by telling the plans to purposed new residents. Just the simple truth of what is public record, is it not? No doubt what is not used in their marketing and sales pitch to potential home buyers. We are not talking about a need for rental property in the area since Sage Creek is right down the road and townhomes already on Shallow Pond Drive. There is more of a need for a childcare, church, deli, etc. here in our neighborhood. Let's be reasonable here! Do we need more rental property, where is our ethics here? Yes the units will be sold and what is done after the sale is out of Kern's hands, but we know the obvious. It is simply ridiculous to read your definition; there are those of us who won't quietly stand by, or lets say be pushed aside... The definition is not clear at all to me and I believe it is intended to read a such. What FURTHER defines a (1) "neighborhood recreation center" (2) "place of assembly" and (3) Community - what do you consider a community? At current time, the "community assembly room" can only hold 25 households without children. What is the total number of houses going to be in this "community"? Right now I count approximately 200! Please clarify. The two qualifying uses of this neighborhood center consist of: (1) a "neighborhood recreation facility" in the form of a community swimming pool, and (2) a "place of assembly" in the form of a community assembly room. As a result of this neighborhood center, Tract A of Fossil Lake P.U.D. First Filing is permitted to have up to 80 multi -family dwelling units. If the Clubhouse at Fossil Lake Ranch is considered in your words Mr. Jones; use on Tract A of neighborhood service or commercial uses such as daycare, church, office, photo studio, etc. In the event one or more of these types of neighborhood service or commercial uses occurs on the other properties within a 3/8 mile radius of Tract A, then the Developer shall be permitted to have a maximum of 80 multi -family dwelling units on Tract A." and you find it more necessary to define to us here Since the time the development agreement was signed, there has been a neighborhood center constructed within a 3/8 mile radius of Tract A, namely the Fossil Lake PUD's community building and pool complex is located within 1000 feet of tract A. For clarification, 3/8 of a mile is 1,980 feet. The two qualifying uses of this neighborhood center consist How does the HOA dues play into the neighborhood rec and/or area for assembly here? The distance is pretty elementary here Mr. Jones and not the problem, the issue here is whether one would consider this dwelling a neighborhood center? A $300 deposit is needed just to allow one access to the clubhouse, it is exclusive and private, that is, it is not free for anyone to come and go at any certain hour. When the clubhouse is reserved with $300, it is used only for the person which reserves purpose. It is not open, as say a deli, church, daycare is to ANYONE who wishes to walk into. ONE MUST HAVE IN THE LEAST $300 AND BE INVITED FOR WHATEVER GATHERING, not to mention it only holds 50 people and has to be RESERVED and only certain days of the week. The pool is not a different situation, you must pay more than $300 for its use and please let us not forget the very low end play area that is there. They (Everitt and Kem) have done the very least to get by your office, Fort Collins Gov, and it is shameful. How is this of service to us, we must give a lot of money, to have exclusive use, and can only assemble at a maximum of 50 people. Do we pay this sort of money week after week to use a deli, church, etc.? Can a non Christian walk into a Christian church and attend? One cannot if they are not invited to the clubhouse. You cannot just simply attend, visit, or gain and benefit from, except that it is a pretty building off there in the distance under lock and key...
