New structures are allowed outside of the City's floodway or product corridor, but
not within the City, s floodway or product corridor.
• Because the building pads have been removed from the floodplain, which also results
in the removal from the floodway and product corridor during the County's land use
adoption process and are no longer in the floodplain, new structures would be allowed
if the other applicable City floodplain regulations listed below are met.
Additional fill would not be allowed in the area of the City's floodway or product
• corridor. This would require either the area of fill to be removed from the floodplain
through the map revision process or a study to show that no net increase in fill is
occurring for the panting or landscaped area.
• > by land access would be required from property outside of the floodpWm to each of
the new buildings surrounded by the City's floodway or product corridor. This dry
access is established to ensure vehicle movement to and from the buildings during
flooding and needs to be elevated just above the loo-year flood elevation.
• Floatable materials would not be allowed outside of any enclosed structure.
Listed above are those floodplain regulations that would be applicable to the development
today, any new regulations that may be adopted between today and the application of the
building permits would also apply. At this time I'm not aware of any changes to the
existing regulations that are being considered.

Re: Hudek Business Park — Poudre Floodplain Regulations
Dear Don,
With this correspondence I would like to summarize our discussion of the City's Poudre
River floodplain regulations as they pertain to the proposed new development entitled
"Hudek Business Park". The Hudek Business Park is located on the south side of East
Mulberry Street with the entire parcel located in the Poudre River floodplain. The parcel
is proposed to be subdivided into five lots with one of the lots associated with the already
existing structure. Approximately the southern third of the parcel is located in Larimer
County's regulatory one-half foot rise floodway. The City's regulatory floodway-product
corridor encompasses about three/fourths of the southern portion of the property (see the
attached map).
This new development is being proposed under the jurisdiction of Larimer County and
sometime in the future may be annexed into the City of Fort Collins_ You have inquired
as to the effect of annexation on this property. Any building permits issued after
annexation would be required to meet the City' a floodplain regulations applicable at that
time.
The County's current regulations do not allow creation of new building sites anywhere
within the floodplain, whether floodway or flood fringe_ For this reason, building sites on
the proposed four new lots would have to be removed from the floodplain through the
Federal Emergency Management Agency map revision process prior to being created.
In regard to the City's floodplain regulations that would be applicable at the time of
building permit issuance, assuming approval of the plat by the County before annexation
into the City and the building pads removed from the floodplain through the map revision
process, would be as follows:
