UNDERSTOOD AND WILL PROCEED WHEN WE HAVE RECEIVED THE DEVELOPMENT AGREEMENT FROM THE CITY [11/10/05] The outcome on the question of the lack of existing public improvements is as follows: The estimate for the cost required of the project to upgrade Frey Street and Mountain Avenue is $64,733.20. This dollar amount was based upon an estimate in September 1999 and does not account for inflation. The applicant has several options with regards to fulfillment of the street improvement requirement: 1) Provide the funds referenced above to the City (adjusted for inflation at the time of payment), or 2) Work out a payment plan for the fund noted with terms acceptable to both the applicant and the City, or 3) Agree to improve Frey Street and Mountain Avenue frontages at such time when the City determines the improvements are needed. In addition, the applicant would agree to not opposing the formation of a special improvement district for either Frey Street or Mountain Avenue. Should the applicant choose this option, the deferral of costs is sufficient for only the roadway portion, not the sidewalk. The applicant will still be required to Page 1
