Consent Agenda. The Planning and Zoning Board voted 5-0 (as part of the Board's Consent Agenda) to recommend that this property not be included in the Residential Neighborhood Sign District, 1 NEW July 6, 2004 -3- Item No. 21 A-C The surrounding zoning and land uses are as follows: N: C, I in Larimer County; existing commercial E: C, FA in Larimer County; existing commercial, residential S: C, LMN in City of Fort Collins; existing residential, natural areas W: C in City of Fort Collins, Larimer County; existing commercial, natural areas The property is 3.04 acres in size and is located on the south side of East Mulberry Street. It includes street rights -of -way for portions of Timberline Road, Frontage Road, Countryside Drive, Cairns Court; and, a st to g the -pest side of Timberline Road. Staff is recommending that this property not be included in the Residential Neighborhood Sign District. A map amendment would be necessary to place this property on the Residential Neighborhood Sign District Map. Findinas: 1. The area meets the eligibility requirements included in State law to qualify for an involuntary annexation to the City of Fort Collins. 3. On June 1, 2004, the City Council considered a resolution determining that the proposed annexation process for this property by establishing the date, time, and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. STAFF RECOMMENDATION: Staff recommends adoption of the annexation and requested zoning. Staff is recommending that this property not be included in the Residential Neighborhood Sign District. The area to be annexed is unincorporated municipally -owned land. In accordance with CRS 31-12-106 Annexation of Enclaves, Partially Surrounded Land, and Municipally Owned Land, when the municipality is the sole owner of the area that it desires to annex, which area is eligible for annexation as set out in CRS 31-12-104(1)(a) and CRS 31-12-105, the governing body ^cnxvd area to the municipality without complying with: j • CRS 31-12-108 Setting He aNg'ce,fyen; or • CRS 31-12-109 Hearing. The annexing ordinance shall state that the area proposed to be annexed is owned by the annexing municipality and is not solely a public street or right-of-way. . The property is located within the Fort Collins Growth Management Area (GMA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreements, the City will agree to consider annexation of property in the GMA when the property is f a c ng State Law. This property gains the required 1/6 contiguity to existing City limits from common boundaries with the Riverbend Annexation (July, 1980) to the south and west and the Riverbend Third Annexation (August, 2000) to the south. Second Reading of Ordinance No. 109, 2004, Amending the Zoning Map and Classifying for Zoning Purposes the Property Included in the Mulberry East First Annexation to the City of Fort Collins, Colorado. On July 6, 2004, Council adopted 5-0 (Councilmembers Hamrick and Roy were absent) Resolution 2004-078 Setting Forth Findings of Fact and Determinations Regarding the Mulberry East First Annexation. Also on July 6, 2004, Council adopted 5-0 (Councilmembers Hamrick and Roy were absent), Ordinance No. 108, 2004 and Ordinance No. 109, 2004, annexing and zoning 3.04 acres located on the south side of East Mulberry Street and west of Timberline Road. The property is developed. It includes a storm water drainageway and streets. It is in the FA Farrning Zoning District in Larimer County. This is a voluntary annexation of City -owned property.
