During the Board's Work Session, staff indicated that a solution for pedestrian connectivity along Wood
Street had not been reached. As of today, an agreement has been reached to design the Wood Street
sidewalk in the following manner, which satisfies the connectivity standards in Section 3.6.3 of the Land Use
Code:
Shift Wood Street Roadway to the east approximately 6 feet, remove the parkway and attach
the sidewalk.
• This keeps the sidewalk on the Pateros Creek side in the same location as currently
planned thus not further impacting their site or landscape buffer.
Provide an attached sidewalk on the West Side of Wood Street along the service center frontage
which would satisfy the pedestrian connectivity standard for the project.
• The attached sidewalk will be approximately 6" higher than the previously proposed
curb and gutter immediately adjacent to the existing ash trees and thus minimize the
cut near the tree roots.
Look to mimic the landscaping on the Pateros side behind the walk to the landscaping along the
Service Center side to create a consistent corridor look with attached sidewalk on both sides.

Public safety and convenience, maintaining public use, and optimizing the use of limited
physical capacity of right-of-way are among the objectives of the Larimer County Urban
Area Street Standards (LCUASS) — Repealed and Reenacted April 1, 2007. It is with
those considerations in mind that this variance request letter has been prepared. This letter
is provided pursuant to Section 1.9.4 of LCUASS to document a proposed site condition
that does not comply with the current standards.
The criterion in question is the width of front yard utility easements paralleling the public
right-of-way. Both Harts Gardens Lane and Peregoy Farms Way are classified as residential
local streets. Therefore, LCUASS Figure 7-9F dictates a typical utility easement width of
9'. A variance is hereby requested to have a front yard utility easement width of 6' instead.
The proposed 6' front yard utility easement was discussed at length during a Utility
Coordination Meeting held on 08.01.13 at the City of Fort Collins building on 281 N.
College Ave. There were no objections from any of the utility providers present. Xcel
Energy is the primary user of the front yard utility easement. Xcel is not concerned with the
6' width so long as no other utility mains or pedestals are installed in the front yards. It
was agreed that cable and telephone facilities will be installed in the rear lots to allow de
facto "exclusive" use of the 6' easement for Xcel's gas mains.

The proposed 6' front yard utility easement remains adequate for the public utility providers
serving the Pateros Creek subdivision. In particular, Xcel Energy intends to install natural
gas facilities in front yards paralleling the residential local streets, and will be the only
utility main occupying the 6' easement. Cable and telephone mains will be installed in
utility easements along the rear lots. The requested variance is not expected to pose an
increased detriment to public health, safety or welfare. This variance will not reduce the
design life of any public improvements or significantly increase future City maintenance
costs.

mind that this variance request letter has been prepared. This letter is provided pursuant to
Section 1.9.4 of LCUASS to document a proposed site condition that does not comply with the
current standards.
The criteria in question are the design speed for a local residential street and the resultant length
of the corner sight distance as depicted on LCUASS Figure 7-16. According to the figure, the
northbound stop condition on Peregoy Farms Way would require a 260' intersection sight
distance looking east along Harts Gardens Lane. The roadway classification of Harts Gardens
Lane is a Local Residential Street, which calls for a design speed of 25 mph. A variance is
hereby requested to utilize a design speed of 20 mph when calculating corner sight distance,
resulting in a required distance of 210' instead. Note, the proposed sight distance of 236' falls
somewhere in between a design speed of 20 and 25 mph.
This variance is requested as a result of physical site limitations. In particular, the existing site
constraints related to the Poudre River to the north and east, as well as the existing pond to the
south of the project, and Wood Street to the west. These constraints, along with associated
setbacks, buffers, floodplains, and existing trees to be preserved significantly limit the options for
roadway locations and alignments. These constraints are further compounded by the need to
provide access to the existing Fleet Services Building on the west side of Wood Street, while also
allowing for the possibility of a future connection to the undeveloped parcel to the north and west
of the project. There are also Urban Estate cluster plan principles and design objectives to create
vibrant streetscapes, which encourage front porches engaging the public sidewalk.

As a consequence of the site constraints, and the resulting roadway geometry, use of the 25 mph
design speed does not seem appropriate. Actual speeds at the intersection are expected to be
lower than what is typically found on a local residential street as a result of the street
configuration.
The proximity of the corner to the east provides limited distance for vehicle acceleration
approaching the intersection. Also, the two horizontal curves in the vicinity of this intersection,
including the sharp turn to the west onto Wood Street will naturally force lower driving speeds.
Curb extensions have also been introduced at the intersection to further slow vehicle speeds. As
an added benefit to public safety, the extensions will narrow the street to 20' to provide a refuge
for pedestrians as they prepare to enter the roadway, both shortening the crossing length and
calming traffic. The presence of on -street parking to the east is expected to further limit vehicular
speeds. These physical roadway elements justify the use of a 20 mph design speed.
The requested variance is not expected to be detrimental to public health, safety or welfare. The
purpose of the standards in question are to provide a safe intersection for vehicles and pedestrians
alike. The decreased vehicle speed resulting from the roadway geometry and curb extensions
outlined in this variance will meet the purpose of the original standard equally well or better than
strict compliance would have. While the requested 20 mph design speed would result in a
required sight distance of 210', a distance of 236' is actually being proposed. This will provide a
sight distance easement that exceeds the LCUASS minimum for a 20 mph design speed.
The alternative design speed will not inherently reduce the design life of the public improvements,
nor will it have any impact on capital or maintenance costs.

As we discussed' our intentions have always been to obtain a deed of dedication from our neighbor so that direct access
toour project can beaccomplished during the development. This position was further supported byaexecufedLetter

changes their- mind and will not execute the Deed of Dedication, our only options are not a dead project or Frninent
Domainasynuare suggesting. As in many instances, other alternatives have been to include the design of these
.n',�'ovementxand continue towork towards obtaining the Deed of Dedication, ultimately requiring that property
owner�oromp|eteconnectivity upon their property being improved. Or, insome cases ainterim design isimplemented
until the ultimate design can beaccomplished.
Late last night the adjacent land owner did return an email I sent to her regarding this issue, and she stated that her
intentions are eriU to execute the Deed of Dedication. Our project has been held uponthis issue for over a month
novv� she hasnot scntthe document toher lender for approval, sowho knovvshovvrnuchlonger this itemouu|6
Lake Obviously, since she is riot required to grant the right-of-way, we are not in a leveraged position to push or
expedite this document. This process is totally out of our control so acquiring the Deed of Dedication could take days or
could take months.
Considering our interpretation of the Code, our satisfactory of this interpretation in our design, and precedent set by
nun-ierous projects throughout our city, we ask that the Deed of Dedication not be a requirement of execution and
recording of the plat (knowing we will need remove the call -out of the dedication on the plat) and project plans. We will
continue to work diligently to obtain this Deed of Dedication, and if not obtained by the time Certificate Of OCCUpancy's
are requesLed in the project, we will agree to a interim connectivity design.

I am following up with you on a couple of questions you had yesterday regarding the dedication of the portion of Right
of Way for Pateros Creek that exists on the Livingston Property. As we discussed yesterday this portion of right of way is
needed on the north side of Wood Street to allow for a proposed sidewalk. This sidewalk will provide the required
pedestrian connectivity that was needed for approval of the project through public hearing.
It is my understanding that you have had a difficult time corresponding with representatives from the Livingston
Property and the dedication has not progressed any further than the letter of intent that was submitted at
hearing. Unfortunately this dedication is required in order for the Pateros Creek to have final signature from the City of
Fort Collins. You had suggested that the Right of Way not be dedicated at time of approval and provisions be placed
within the Development Agreement. After discussing with Engineering staff it has been our position in the past and still
is to obtain all right of way required for a project prior to final approval.
Eminent domain is an option that could be a last resort for your project if you continue to not be able to contact the
Livingston Property. I have attached a PDF that outlines this process that was adopted by City Council in 2001. The City
would recommend that you continue efforts to contact the Livingston's prior to pursuing the eminent domain process as
a last resort.

Thank you for the quick response. It always amazes me how simple communication can break down in these
situations.
Regarding the snow removal, we can not legally obligate the future homeowners association with the snow
removal on your property. However, as long as we are in control of the association, once the walk is installed
we will add that area to our snow removal 3rd party contract. Additionally, we will communicate our intentions
to the future home owners association and ask that they do the same. Considering how small this area is, 1
really do not see a problem. And, considering how disconnected it is to your home, we totally understand your
r�:duR:st.
Regarding access to your property for continued farming operations, the walk is designed with a curb -cut and
approach intentionally to allow for access. Of course, as we discussed we are in frill support of your continued
farming operations.
Deed of Dedication - this document also requires any lien holders on your property to agree to the dedication. I
believe in this case your lender is Key Bank. In our experience, unless you have a very good local relationship
with your lender, it can take several weeks to get this document signed.... usually by someone who doesn't know
anything about your property. The whole process can be cumbersome, so we would love to see this process
started as soon as possible, and we are more than happy to help.
Hopefully this correspondence can provide addition comfort serving as future evidence of our commitment on
the snow removal
Considering the time sensitivity, I will text you this as well (as you suggested).

As the Owner of the property located adjacent to the proposed Pateros Creek
development, I am aware that additional right-of-way would need to be granted from me
at the north end of Wood Street, as currently designed. I hereby affirm my willingness to
dedicate approximately 220 square feet for public right-of-way. This includes the
permanent dedication listed above, as well as any temporary easements necessary to
construct the right-of-way along the Wood Street corridor.
For the purpose of this letter of intent, the area to be dedicated is currently a part of PR
Stables, located at 930 North Shields Street, and abuts the north end of 830 Wood Street
and the west side of 912 Wood Street, depicted in the attached surveyed plat sheet. The
area to be dedicated is currently an access point to PR Stables pasture and hay field. It is
understood and agreed upon with the developer that this area shall remain an access
point to PR Stables land. It is also understood and agreed upon with the developer that
the reconstructed east boundary fence of PR Stables will be located at the legally defined
property line.
The right-of-way is expected to be officially dedicated by separate documentation,
including definition by legal description, during the processing of the Final Plan through the
City of Fort Collins (aka, Final Compliance) for the Pateros Creek development application.
Please notify me should there be any changes to the proposed project that would affect

theash trees that are immediately adjacent toWood Street. The impacts ofthe sidewalk fill and/or cut aswell as
impacts of constructing the curb and gutter adjacent to the ash trees would be severe to many if not all of the ash
trees. Wes and Glen had concerns with constructing the meandering sidewalk within the trees as this area functions as
a detention pond and the increased fill might decrease the volume of detention and need to be studied further.
A continuous pedestrian connection to a public sidewalk is required for this project. This sidewalk would provide the
connection from the intersection of Harts Farm Road and Wood Street to extend south to the existing public sidewalk
that exists just south ofthe project onthe west side ofWood Street, Atthe site visit itwas suggested that the east
sidewalk along Pateros project be enhanced and extended south of the project and pedestrians would cross midblock to
the existing west sidewalk. A midb|ockcrossin8 will not be supported by transportation staff so we will not be ab|e to
make the connection from the east walk to the west walk south of the project.
We discussed the concerns brought up from Forestry and Stormwater this morning at our Transportation Coordination
rneeting this morning and have determined a few options the applicant could consider that transportation staff is in
support of;
Shift the road section to the east approximately 6-8 feet to allow for an attached walk and curb and gutter on
the west side of wood street. The 6 inch vertical curb should help in reducing the cut immediately adjacent to
the ash trees during construction.
Transplant the trees and keep the road section in its current location and add an attached sidewalk to the
vertical curb and gutter. The transplanting of the trees would need to be discussed with Tim Buchanan but it
could be possible to utilize them as street trees on the east side or a part of the mitigation within the project:
site.
Continue with the meandering of the sidewalk between the pine trees and ash trees in a manner that addresses
the concerns of stormwater and forestry. Also addressing the concerns of the vertical curb and gutter impact on
the ash trees.
For hearing we will need to know how the applicant would like to proceed with any of the above options and some
confirmation from Forestry and Stormwater that they are agreement with the direction they choose. We will gladly hear
any other options that the applicant or staff might have but ultimately we will need initial buyoff from transportation,
engineering, forestry and stormwater.

Trail Connection from Wood Street to the Poudre River Trail:
• Two letters have been received regarding the trail connection from Wood Street to the Poudre River Trail.
One letter expresses concern regarding the trail connection, and the second letter suggests the trail is not
wide enough and needs to provide emergency access.
• Staff response — I spoke with Craig Foreman, the Parks Planning Director, and he and I discussed that
the trail connection is required because the Fort Collins Parks and Recreation Policy Plan requires that
"trails are safe and convenient and are connected to residential areas, civic institutions and
businesses, and to neighboring communities, and that "the trail system is connected to the on -street
bicycle and pedestrian network" (see page 11 of the plan).

In addition, the 2012 Trails Study (to be presented to Council this fall) will require trail connections be
provided at a minimum of a % mile interval. As the distance between access points to the trail (Shields
Street and Lee Martinez Park) will be greater than % mile, not providing this trail would be
inconsistent with this study and the City's connectivity standards (Section 3.6.3 of the Land Use Code).
City staff feels this connection is important for trail users since it provides a direct link for residential
neighborhoods in this area to reach the Poudre Trail. This connection provides a much safer trail
access than is available on Shields Street with its substantial traffic volumes or by requiring users to
connect to the trail through the Pateros Creek Development. The City has had numerous requests
from residents over the years for this trail connection and has been waiting for this opportunity to
better serve this section of our community. We are very supportive of this connection and being able
to work with the developer to make this connection a reality. Craig also noted that the City works
closely with landowners to ensure the trail is a good neighbor; they will continue to do so on this
connection.
As the Land Use Code requires any project to be in compliance with the Parks and Recreation Policy
Plan (Section 3.4.8 of the Land Use Code), a Modification of Standard would be required should a trail
connection not be required.
I also confirmed with Craig that the trail would be 8' wide and would provide emergency access. Craig
will review the proposed paving during the Final Plan review and determine if it meets City standards.
