SOIL OF ALL LANDSCAPE AREAS TO A DEPTH OF AT LEAST SIX (6) INCHES BY TILLING, DISCING OR OTHEER SUITABLE
METHOD, Al A RATE OF AT LEAST THREE (3) CUBIC YARDS OF SOIL AMENDMENT PER ONE THOUSAND (11,000) SQUARE
FEET OF LANDSCAPE AREA.
8. PLANTS ARE SIZED AS CALLED OUT ON PLANT LIST UNLESS OTHERWISE NOTED ON PLANS.
9. A PERMIT NAUST BE OBTAINED FROM THE CITY FORESTER BEFORE ANY TREES OR SHRUBS AS NOTED ON THIS PLAN ARE
PLANTED, FIRUNED OR REMOVED ON THE PUBLIC RIGHT-OF-WAY. THIS INCLUDES ZONES BETWEEN THE S3IDEWALK AND
CURB, MEDIANS AND OTHER CITY PROPERTY. THIS PERMIT SHALL APPROVE THE LOCATION AND SPECIES TTO BE PLANTED.
FAILURE TO OBTAIN THIS PERMIT MAY RESULT IN REPLACING OR RELOCATING TREES AND HOLD ON CERTIIFICATE OF
OCCUPANCY,
10.THE DEVELOPER SHALL CONTACT THE CITY FORESTER TO INSPECT ALL STREET TREE PLANTINGS AT THE COMPLETION OF
EACH PHASE OF DEVELOPMENT. ALL TREES NEED TO HAVE BEEN INSTALLED AS SHOWN ON THE LANDSCAPE PLAN.
APPROVAL OF STREET TREE PLANTING IS REQUIRED BEFORE FINAL APPROVAL OF EACH PHASE. FAILURE ?TO OBTAIN
APPROVAL BY THE CITY FORESTER FOR STREET TREES IN A PHASE SHALL RESULT IN A HOLD ON CERTIFICATE OF
OCCUPANCY FOR FUTURE PHASES OF THE DEVELOPMENT.
11. STREET TREES IN THE RIGHT OF WAY AREAS ADJACENT TO INDIVIDUAL LOTS SHALL BE PLANTED BY THIE LOT OWNERS
PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY FOR THAT LOT. STREET TREES IN THE RIGHIT OF WAY
AREAS ADJACENT TO HOMEOWNER ASSOCIATION OWNED AREA SHALL BE PLANTED BY THE DEVELOPER #ITH EACH PHASE
OF DEVELOPMENT. ALL STREET TREES ASSOCIATED WITH EACH PHASE SHALL BE SECURED BY THE DEVELOPER WITH AN
IRREVOCABLE LETTER OF CREDIT IN THE AMOUNT OF 125% OF THE ESTIMATED COST OF THE MATERIALS AND
INSTALLATION OF ALL TREES, WHICH SECURITY MAY BE REDUCED AS TREES ARE PLANTED. IN THE EVENT SEASONAL
CONDITION; CAUSE TREE PLANTING TO BE POSTPONED, THE OWNER OF THE ADJACENT PROPERTY WHERtE THE TREE(S)
ARE REQUIRED SHALL SECURE SAID TREE(S) WITH A FINANCIAL INSTRUMENT AND IN AN AMOUNT ACCEPTABLE TO THE
CITY, WHEFREBY THE CITY SHALL ISSUE THE CERTIFICATE OF OCCUPANCY AND RELEASE THE SECURITY PIREVIOUSLY
POSTED BY THE DEVELOPER FOR SAID TREE(S). AT THE TIME ALL STREET TREES HAVE BEEN PLANTED (OR SECURED BY
ANOTHER 4RTY, THE SECURITY SHALL BE RELEASED IN IT'S ENTIRETY TO THE DEVELOPER.
12. A HOMEOWNER'S ASSOCIATION WILL BE FORMED TO MAINTAIN LANDSCAPING IN PUBLIC ROW'S ALONG LE- AVENUE, AS
WELL PROTECT SIGNS AND BRICK COLUMNS AND THE MEDIAN LOCATED ON LINDEN GATE COURT. HOMEO)WNER'S WILL BE
RESPONSIFILE FOR MAINTAINING LANDSCAPING WITHIN AND ADJACENT TO THEIR LOTS ON ALL LOCAL STfREETS.
13.THE MEDIAN SHALL BE DRIP IRRIGATED, NOT SPRAY IRRIGATED. MEASURES WILL BE TAKEN TO REDUCE (EXCESS WATERING
AND WATERING WHERE EXCESS WATER RUNS INTO THE STREET OFF OF THE MEDIAN.
14. ANY FEN(;ING ALONG NORTH LEMAY AVENUE SHALL BE INSTALLED A MINIMUM OF 2' BEHIND BACK OF 'SIDEWALK.
15. NO DEVELOPMENT OR WORK WILL OCCUR IN THE DRY CREEK FEMA REGULATORY 100 YEAR FLOODWAY.
