PZ98-26 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING THE UTILITY, ACCESS AND DRAINAGE EASEMENT DEDICATED ON TRACT 1 OT THE SEVEN LAKES P.U.D. PHASE II, SUBDIVISION WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval of replats containing notation of such vacation; and WHEREAS, the Owner of TRACT 1 of the SEVEN LAKES P.U.D., PHASE II has requested that the City vacate the utility, access and drainage easement dedicated in the SEVEN LAKES P.U.D., PHASE II, and more particularly described below; and WHEREAS, the vacation request has been reviewed and approved by the pertinent City Departments, and report no objections. NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins, that the UTILITY, ACCESS and DRAIANGE EASEMENT dedicated on TRACT 1 of the Seven Lakes P.U.D. , Phase II,Subdivision, more particularly described as follows to wit: A utility, access and drainage easement situate in TRACT 1, SEVEN LAKES P.U.D.PHASE II, City of Fort Collins, County of Larimer, State of Colorado which begins at the NORTHEAST corner of said Seven Lakes P.U.D. RECOMMENDATION: Staff recommends approval of Resolution PZ98-25. EXECUTIVE SUMMARY: The Owner has requested the vacation of a portion of the easement dedicated on Tract 1, in the Seven Lakes P.U.D. Phase II Subdivision to accomidate a future expansion of an existing building. The Utility Companies have been contacted with the request to vacate and there are no objections.
