DESCRIPTION OF A PORTION OF A UTILITY, ACCESS AND DRAINAGE
EASEMENT TO BE VACATED:
A tract of land being a portion of Tract 1, a utility, access and drainage easement to be
vacated, located in SEVEN LAKES P.U.D. PHASE II SUBDIVISION situate in the
Southwest Quarter of Section 17, Township 7 North, Range 68 West of the 6th Principal
Meridian, City of Fort Collins, County of Larimer, State of Colorado, being more
particularly described as follows:
Considering the North line of said Seven Lakes P.U.D. Phase II Subdivision as bearing
North 84049'00" West and with all bearings contained herein relative thereto:
Commencing at the Northeast corner of said Seven Lakes P.U.D. Phase II Subdivision,
thence along the North line of said Seven Lakes P.U.D. Phase II Subdivision, North
84049'00" West, 381.25 feet; thence, South 00000'00" West, 179.15 feet to the POINT
OF BEGINNING; thence, South 00°00'00" West, 137.95 feet; thence, South 45°00'00"
West, 24.08 feet; thence, North 45°00'00" West, 74.92 feet; thence, North 00°00'00"
West, 26.00 feet; thence, North 90000'00" East, 35.00 feet; thence, North 00000'00" West,
76.00 feet; thence, North 90°00'00" East, 35.00 feet to the Point of Beginning.
The above described tract of land to be vacated contains 6,640 square feet more or less
and is subject to all easements and rights -of -way now on record or existing.

RESOLUTION NO. PZ98-26
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING THE UTILITY, ACCESS AND DRAINAGE EASEMENT DEDICATED ON
TRACT 1 OT THE SEVEN LAKES P.U.D. PHASE II, SUBDIVISION
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of TRACT 1 of the SEVEN LAKES P.U.D., PHASE
II has requested that the City vacate the utility, access and
drainage easement dedicated in the SEVEN LAKES P.U.D., PHASE II,
and more particularly described below; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent City Departments, and report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins, that the UTILITY, ACCESS and
DRAIANGE EASEMENT dedicated on TRACT 1 of the Seven Lakes P.U.D. ,
Phase II,Subdivision, more particularly described as follows to
wit:
A utility, access and drainage easement situate in TRACT
1, SEVEN LAKES P.U.D.PHASE II, City of Fort Collins,
County of Larimer, State of Colorado which begins at the
NORTHEAST corner of said Seven Lakes P.U.D. Phase II

PROJECT DESCRIPTION:
Request to vacate a portion of the utility, access and drainage
easement dedicated Tract 1, in the Seven Lakes P.U.D.,Phase II
subdivision, located North of East Prospect Road and West of the
Poudre River.
RECOMMENDATION: Staff recommends approval of Resolution PZ98-25.
EXECUTIVE SUMMARY:
The Owner has requested the vacation of a portion of the
easement dedicated on Tract 1, in the Seven Lakes P.U.D. Phase II
Subdivision to accomidate a future expansion of an existing
building. The Utility Companies have been contacted with the
request to vacate and there are no objections. Therefore, the
easement can be vacated.
