Dear Council Members;
In concert with the filing of Quail Hollow Phase One, it is
necessary that the easements and rights -of -way previously
dedicated on the site as part of the Dixon Creek PUD be vacated.
This letter is written to request that vacation upon approval of
Phase One of the Quail Hollow PUD by the Planning and Zoning
Board. The attached exhibit illustrates the dedications to be
vacated.

RE: Quail Hollow PUD
I have been working with Mike Herzig regarding the request
of the developer of Quail Hollow PUD that he not be required to
form a Home Owner's Association for the purpose of maintaining
landscaping which has been required of him by the City. The
City has required that the developer include, as a part of the
development, a strip of landscaping along Drake Road in order to
provide for a more attractive streetscape in that area. The
developer did not wish to form a Home Owners Association for pur-
poses of maintaining the streetscape and has accordingly agreed
to impose upon the owner of each lot abutting the street an
affirmative obligation, through protective covenants or deed
restrictions, to maintain that landscaping on an individual
basis. If an individual lot owner should fail to so maintain the
landscaping, the City may take action against the individual lot
owner in accordance with the Code of Ordinances and also in
accordance with the protective covenants. Although this solution
is probably superior to any solution heretofore developed with
regard to standard subdivisions, to my thinking it is not as
desirable as the creation of the Home Owners Association, as is
typically required of a Planned Unit Development. It seems to me
that the best mechanism for requiring a developer to perform
maintenance obligations is through a Home Owners Association. We
may also wish to consider modification of our streetscape
requirements or a determination as to whether or not the City
would be willing to assume the maintenance responsibility for
streetscapes at its own expense.

P.S. Please be sure to monitor the progress of Quail Hollow
so that no building permits are issued until the City
has received and approved the restrictive covenants as
,fired by the development agreement.

Dear Mr. Stringer:
United Bank of Fort Collins N.A. has a development loan to d. Jensen
Enterprises in Quail Hollow PUD. In the cost breakdown there are
$100,916.00 reserved for paving. The following calculations are used
to come up with the proper amount of funds on the above —referenced
project. The property has a front lot footage of 128', the street is
42' wide or 21' to the center of the street. A total of 327 square yards
of asphalt and base are to be used at a cost of $7.54 per square yard
including labor, or a total of $2,465.00; this figure multiplied by
150 percent gives a grand total in the amount of $3,697.50.

Re: Street and traffic signs in the Quail Hollow 1st
Dear Mr. Developer:
My office has been informed by Dick Wartenbe of the City Traffic Department
that the signs installed in the Quail Hollow 1st Development do not meet
the City's criteria for signs. Dick has talked with your sign contractor,
Rocky Mountain Safety Services, and was not satisfied with their response.
Therefore, as the developer of this project, it is your responsibility to
the City that your sub -contractors provide acceptable products and work.
Please be informed that until such time as the signs are brought up to the
City standard, Certificates of Occupancy will not be issued for any
structure within this development.
If you have any questions regarding specific corrections to the signs in
this development, please contact Dick Wartenbe at 221-6815.
