Liberty Farms PDP was a request for a long term care facility that was submitted in
August of 2007. The 19.16 acre site that was located north of Vine Drive and East of
Timberline Road was to include ten 2-story buildings. The Larimer and Weld Canal
formed the northern property boundary.
When this project was submitted the Mountain Vista plans and the Master Street Plan
showed that within the boundaries of this property that a 2 lane arterial street would run
east from Timberline Road and turn north crossing the canal. During the course of time
the project was in the system the Mountain Vista plan and the Master Street Plan were
revised and an arterial roadway was no longer shown crossing this property.
The plans were designed with the minor arterial in mind and not modified to change the
design or roadway width before they were signed. The development agreement was
signed by the Developer and the City and the utility plans for this site were signed in
2010. The Development Agreement (DA) was filed at the County. The applicant did not
ever follow up with the filing of the plat with the City before the project expired in 2011.
The delay in filing of the plat was something that the applicant intentionally did. The
engineer who had designed the plans was moving out of the area and they wanted the
City to sign the utility plans before the engineer left, so as to make sure he was around in
order to sign and stamp the final documents. Engineering was not going to sign the plans
without the DA being finalized and entered into. So both of those items were completed,
but the applicant wanted to wait to file the plat until they had to in order to delay the
project vesting for as long as they could.
In 2011 the City had a desire to keep the utility plans on file for informational purposes.
The utility plans were stamped with `Not For Construction — Project Never Finalized'
and placed in the vault. Copies of the signed utility plans without this note may show up
since only the mylars and a single paper copy were stamped. The plans and DA are not
valid since a plat of the property with the legal name of Liberty Farms was not filed.
