[9/27/10] Is it proper to indicate the present zoning designation on the plat? It seems to
imply that the replat sets forth the zoning of the parcel, which isn't the case. If the zoning for
some reasons needs to be indicated, it perhaps would be better served by indicating that
this is the existing zoning and for reference only.

[9/27/10] I'm understanding that from a legal perspective, the development agreement for
the original Penny Flats project would no longer apply to this replatted portion. There are a
couple of options in this regard, 1) an additional development agreement is done (which
may then be legally descriped as applying towards both "Penny Flats Subdivision First
Replat" and "Penny Flats Subdivision"), 2) A note on the plat is added stating that the
development agreement for Penny Flats Subdivision First Replat shall apply to this plat.
