ORDINANCE NO. 55, 1997
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING CERTAIN STREET RIGHTS -OF -WAY AS DEDICATED WITH THE
PLAT OF THE STOCKBRIDGE PUD ENTITLED "STOCKBRIDGE VILLAGE PUD"
WHEREAS, the Owner and Developer of the property previously known as the Stockbridge
PUD ("the PUD") has requested the vacation of the rights -of -way for the residential local streets in
the PUD as dedicated on the plat for the PUD entitled "Stockbridge Village PUD" and more
particularly described below; and
WHEREAS, none of the local residential street improvements for the PUD have ever been
constructed; and
WHEREAS. the Owner has since received preliminary approval of a new planned unit
development on said property which includes a different local residential street layout; and
WHEREAS, the Owner has submitted to the City a final planned unit development for the
property which is currently in the City's development review process; and
WHEREAS, the originally platted local residential street rights -of -way are no longer
necessary or desirable to retain and therefore the Owner has requested vacation of said rights -of -way
in order to be able to replat the property; and
WHEREAS, all public and private utility agencies, the Poudre Fire Authority, and the City
Transportation staff have been notified of the proposed vacation and report no objection; and
WHEREAS, vacation of the rights -of -way will not leave any land adjoining said rights -of -
way without an established public road or private -access easement connecting such adjoining land
with another established public road; and
WHEREAS, the rights of the residents of the city of Fort Collins will not be prejudiced or
injured by the vacation of said rights -of -way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the rights -of -way for the local residential streets in the PUD as originally dedicated
on the plat for the PUD, as shown on Exhibit "A" attached hereto and incorporated herein by this
reference and which is on file in the office of the City Clerk, and more particularly described as
follows, to wit:
All of the dedicated public street rights -of -way for Woburn Way, Waterbury Lane, Lennox
Drive, Lennox Court, and Walpole Drive, according to the recorded plat of Stockbridge PUD
(entitled "Stockbridge Village PUD") in the City of Fort Collins, County of Latimer, State
of Colorado, and recorded in Book 2129, Page 0218-0219 of the records of the Larimer
County Clerk and Recorder.
be, and the same hereby are, vacated, abated, and abolished. This Ordinance does not vacate any of
the dedicated public street rights -of -way for west Horsetooth Road nor for Seneca Street as dedicated
with the recorded plat for the PUD entitled "Stockbridge Village PUD".
Introduced, considered favorably on first reading, and ordered published this 18th day of
March, A.D. 1997, and to be presented for final passage on th�si day of April 6P-ItJ9-7.
