Re: REOUEST FOR VACATION OF PORTION OF UTILITY AND ACCESS EASEMENT
Dear Ms. Ashbeck:
We, the undersigned, as owners of that property, known by
street and number, as 4531 BOARDWALK BLDG X & Y, FORT COLLINS,
COLORADO 80525, and legally described in the accompanying copy of
a Warranty Deed dated July 31, 1995, and recorded with the Larimer
County Clerk and Recorder on August 2, 1995, at Reception
No. 95046133 (the "Property"), hereby petition the
Planning/Development Department of the City of Fort Collins to
vacate a portion of that certain Utility and Access Easement
dedicated under that plat known as Amendment to the Pier Being a
Replat of a Portion of The Pier Condominiums at the Landings P.U.D
and recorded July 28, 1982, in Book 2178 at Page 302 of the records
of Larimer County (the "Easement").
A copy of the above -referenced plat, together with a copy of
an Improvement Survey Plat of the Property, are enclosed for your
use. Upon review of the Improvement Survey Plat you will note that
the south boundary of the Easement intersects the Property and that
a small portion of the northwest corner of Building Y is located on
the Easement. (The south boundary of the Easement and Building Y
have been highlighted on the Improvement Survey Plat.)
We hereby request the approval and the vacation of that
portion of the Easement legally described on Exhibit A attached to
this letter. This legal description has been provided by a
licensed surveyor.

RESOLUTION NO. PZ96-1
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A UTILITY AND ACCESS EASEMENT
ADJACENT TO BUILDING Y OF THE PIER CONDOMINIUMS
AT THE LANDINGS P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements and rights -of -way, by resolution or by
approval of replats containing notation of such vacation; and
WHEREAS, the Owner of Building Y of the Pier Condominiums at the Landings P.U.D.
has requested the vacation of a portion of a utility and access easement, more particularly
described on Exhibit "A", attached hereto and incorporated herewith by this reference; and
WHEREAS, the northwest corner of said Building Y encroaches into a portion of said
utility and access easement; and
WI IEREAS, by vacation of the portion of the utility and access easement described more
particulary on Exhibit "A", the encroachment will be eliminated; and
WHEREAS. all public and private utility agencies have been notified of the vacation
request and report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that the utility and access easement area more particularly described on Exhibit "A",
attached hereto and incorporated herewith by this reference be and the same hereby is vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of
Fort Collins held this 22nd day of January, A.D. 1996.

Situate in Envelope "Y", being a portion of the AMENDMENT TO
THE PIER, according to plat recorded July 28, 1982, in Book 2178
at Page 302 which begins at a point on the boundary line of the
Amendment to the Pier which bears North 00005'25" West 220.00
feet and again South 89°56'28" East 198.00 feet and again South
00°05'25" East 189.96 feet and again South 89°56'28" East 12.41
feet and again North 00009'30" West 7.60 feet and again North
82°53'25" East 119.00 feet from the South Quarter corner of
Section 36, Township 7 North, Range 69 West of the 6th P.M.,
City of Fort Collins, County of Larimer, State of Colorado,
said point being the Southwest corner of said Envelope "Y";
thence North 20°36'33" West 98.45 feet; thence North 00005'25"
West 21.98 feet; thence North 89°45'00" East 27.40 feet to the
TRUE POINT OF BEGINNING of said easement vacation; thence
continuing North 89°45'00" East 10.00 feet; thence South
00°15'00" East 7.00 feet; thence South 89°45'00" West 10.00
feet; thence North 00015'00" .West 7.00 feet to the TRUE POINT
OF BEGINNING.
