EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF PUBLIC UTILITIES
William Michael Hittesdorf and Laurie E. Price, Grantors, of the County of
Larimer, State of Colorado, do hereby grant and convey to the City of Fort
Collins, a municipal corporation, its licensees, successors and assigns, Grantee,
in consideration of the payment by the Grantee of the sum of $10.00, and other
good and valuable consideration, receipt of which is hereby acknowledged, a
right-of-way and easement for the installation and continued operation,
maintenance, repair, alteration, inspection, and replacement of the public
utilities of the Grantee, in the following premises, belonging to the said
Grantors in Larimer County, State of Colorado, in the following location:
A Utility Easement located in Lot 2 of the Plat of Parkwood, First
Filing, a Plat of Record with the Clerk and Recorder of Larimer
County, located in the City of Fort Collins, Larimer County,
Colorado, more particularly described as follows:
Considering the southeasterly line of the said Lot 2 as bearing
South 52°38'30" West, and with all bearings contained herein
relative thereto;
Commencing at the northeasterly most corner of the said Lot 2;
thence along the northeasterly line of the said Lot 2, (being the
southerly right-of-way of Parkwood Drive) 8.38 feet along the arc of
a curve r_onrave to the south-west having a central angle of 01°03'13"
a radius of 455.91 feet, the long chord of the said curve bears
North 54°46'01" West 8.38 feet to a line which is 8.00 feet
(measured at right angles) northwesterly of and parallel with the
said southeasterly line of Lot 2 and to the TRUE POINT OF BEGINNING
of this description; thence along the said parallel line, South
52'38'30" West 5.89 feet; thence leaving the said parallel line,
North 37°21'30" West 5.70 feet; thence parallel with the said
southeasterly line, North 52'38'30" East 4.00 feet to the said
northeasterly line of Lot 2; thence along the said northeasterly
line, 6.00 feet along the arc of a non -tangent curve concave to the
southwest having a central angle of 00°45'15" a radius of 455.91
feet, the long chord of the said curve bears South 55°40'15" East
6.00 feet to the point of beginning.
The above described tract contains 28.2 square feet and is subject
to all easements and rights of ways now existing or of record;
Together with all rights of ingress and egress necessary for full and complete
use, occupation, and enjoyment of the easement hereby granted, and all rights and
privileges incident thereto, including the right, as becomes necessary, to cut,
trim, and remove trees, brush, overhanging branches, and other obstructions which
may injure or interfere with the Grantee's public utility system. Only
utilities which are below surface grade or level with surface grade may be

installed. Grantee shall be responsible for the reasonable restoration of
Grantors' property upon completion of installation or otherwise compensate
Grantors for damage done during construction or subsequent reentry for repair or
reconstruction purposes. The Grantors state that it is the lawful owner in fee
simple of the real property described herein; that it has a good and lawful right
and authority to grant, sell, and convey said property or any part thereof and
that it warrants the title of said property.,
