OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF THE DRAINAGE EASEMENT,
DRAINAGE AND UTILITY EASEMENT AND
ACCESS, DRAINAGE AND UTILITY EASEMENT DEDICATED ON

LOT 3 OF THE GATEWAY AT HARMONY ROAD - PUD, THIRD FILING

r w WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
L' Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Lot 3 of the Gateway at Harmony Road - PUD, Third
Filing has requested that the City vacate portions of the drainage easement, drainage and
;t utility easement and access, drainage and utility easement dedicated on Lot 3 of the
Gateway at Harmony Road - PUD, Third Filing and more particularly described on Exhibits
c� A, B, and C attached; and

r WHEREAS, the vacation request has been reviewed and approved by the pertinent
City and private utilities, and they report no objections.

NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
r of Fort Collins, that an 8 foot portion of the drainage easement, a 10.12 foot portion of the
drainage and utility easement, and a 7 foot portion of the access, drainage and utility
r; easement all of which are dedicated on Lot 3 of Gateway at Harmony Road - PUD, Third
filing shall be and are hereby vacated, which vacated easements are more particularly
x described on Exhibits A, B, and C attached hereto and incorporated herein by this
reference.

Description of "Drainage Easement" to be vacated:
A Drainage Easement located on Lot 3 of the GATEWAY AT HARMONY ROAD -
P.U.D., THIRD FILING, City of Fort Collins, Larimer County, Colorado. The portion of
said Drainage Easement to be vacated being more particularly described as follows:
Beginning at the Northwest corner of said Lot 3 and considering the North line of said
Lot 3 as bearing South 890 53' 13" East with all bearings contained herein relative
thereto; thence along the northerly line of said Lot 3, South 89' 53' 13" East, 12.00 feet to
the TRUE POINT OF BEGINNING; thence South 00' 06' 47" West, 80.00 feet; thence
South 89' 53' 13" East, 8.00 feet; thence North 00' 06' 47" East, 80.00 feet to a point on the
North line of said Lot 3; thence along the North line of said Lot 3, North 89' 53' 13" West,
8.00 feet, more or less, to the TRUE POINT OF BEGINNING.
The above described portion of said Drainage Easement to be vacated contains 640
square feet, more or less.

portion of said Drainage and Utility Easement to be vacated being more particularly
described as follows:
Beginning at the Northwest corner of said Lot 3 and considering the North line of said
Lot 3 as bearing South 89' 53' 13" East with all bearings contained herein relative
thereto; thence along the North line of said Lot 3, South 89' 53' 13" East, 12.00 feet;

VACATING A PORTION OF THE ACCESS, DRAINAGE AND UTILITY
EASEMENT AND A PORTION OF THE DRAINAGE AND UTILITY EASEMENT
DEDICATED ON LOT 3 OF THE GATEWAY AT HARMONY ROAD PUD
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of Lot 3 of the Gateway at Harmony Road PUD has
requested that the City vacate a portion of the access, drainage and utility easement and
a portion of the drainage and utility easement dedicated on Lot 3 of the Gateway at
Harmony Road PUD and more particularly described below; and
WHEREAS, the vacation request has been reviewed and approved by the pertinent

NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
of Fort Collins, that a portion of the access, drainage and utility easement and a portion of
drainage and utility easement dedicated on Lot 3 of the Gateway at Harmony Road PUD
more particularly described as follows to wit:
An Access, Drainage and Utility Easement located on Lot 3 of the Gateway
at Harmony Road PUD, Third Filing, City of Fort Collins, Larimer County,
Colorado. The portion of said Access, Drainage and Utility Easement to be
vacated being more particularly described as follows:
Beginning at the Northwest corner of said Lot 3 and considering the North
line of said Lot 3 as bearing South 890 53' 13" East with all bearings
contained herein relative thereto; thence along the northerly line of said Lot
