GRANT AND DEDICATION OF EASBMFNT
ROGER M. TREE and SUSAN CASILLAS TREE, whose address is 1819 Hull Street,
Fort Collins, Colorado 80526, the owners of those lands described in Exhibit
"A", attached hereto and incorporated herein 4 this reference, for and in
consideration of mutual covenants and agreements herein set forth, Ten ($10.00)
Dollars and other valuable consideration, the adequacy and receipt of which are
hereby acknowledged, does hereby grant, bargain and convey to the CITY OF FORT
COLLINS, COLORADO, its successors, and assigns, the above mentioned property
for the purposes of a permanent easement and right-of-way for storm drainage
utilities, and for the installation, operation, maintenance and access of same,
including without limitation an open drainage channel.
As a part of the consideration hereof, by acceptance of this Grant and
Dedication of Easement, the parties hereto agree to abide by those additional
provisions and terms as stated in Exhibit B, attached hereto, and by this
reference made a part hereof.

PERMANENT EASEMENT
A part of Lot 10 of Cedar. Village Fourth Filing, City of Fort Collins
County of Larimer, State of Colorado, being more particularly described
as follows:
Begin at the Southwest corner of said Lot 10 and runs thence
along the West line of said Lot 10, N 00' 00' 29" W 25.19
feet; therice along the arc of a 70 foot radius curve to the
left a distance of 25.80 feet, the long chord of which bears
S 100 34' 02" E 25.65 feet to the South line of said Lot 10;
thence along said South line N 890 40' W 4.70 feet to the
point of beginning, containing 39 square feet more or less.

ROGER M. TREE AND SUSAN CASILLAS TREE
CITY OF FORT COLLINS, COLORADO
The parties hereto agree:
1. City of Fort Collins, Colorado agrees to construct a
fence along the westerly property line of Roger M. Tree and Susan
Casillas Tree, coincident with the easterly line of open storm
drainage channel. The fence is to be 5 feet high in the back
yard and 4 feet high in the front yard, with the existing wooden
fence left in place. Roger M. Tree and Susan Casillas Tree agree
to provide and install wooden posts for the installation of said
chain ].ink fence.
2. City of Fort Collins, Colorado agrees to install the
following landscaping upon the Roger M. Tree and Susan Casillas
Tree property:
(a) One Flowering Crab - radiant
(b) One Green Ash - Marshall's seedless
(c) One Kentucky Coffee Tree
Location of the above listed landscaping will be determined by
Roger M. Tree at the time of construction contemplated herein.
