HomeMy WebLinkAboutBOSTON CHICKEN AT LEMAY AND PENNOCK PUD - Filed ED-EASEMENT DEDICATION - 2002-11-21i' OFF0r1T'-0LLiH3 # �qg EASEMENT DEDICATION KNOW ALL MEN BY THESE PRESENTS: That the undersigned being the owners of the following described land, to -wit: A portion of Lot 1 of the Boston Chicken at Lemay and Pennock, PUD, City of Fort Collins, County of Latimer, State of Colorado which is contained within the boundary lines which begin at a point on the east line of said Lot 1 which bears N Ol ° 40' 57" E 72.76 feet from the Southeast corner of said Lot 1 and run thence N 89' 17' 30" W 35.00 feet; thence N 01' 40' 57" E 20.00 feet; thence S 89' 17' 30" E 35.00 feet; thence S 01° 40' 57" W 20.00 feet to the point of beginning do hereby dedicate, transfer and convey to the City of Fort Collins, Colorado, for public use forever permanent sanitary sewer line utility easement in the City of Fort Collins, County of Latimer, State of Colorado, more particularly described as follows: A portion of Lot 1 of the Boston Chicken at Lemay and Pennock, PUD, City of Fort Collins, County of Larimer, State of Colorado which is contained within the boundary lines which begin at a point on the east line of said Lot 1 which bears N Ol ° 40' 57" E 72.76 feet from the Southeast corner of said Lot 1 and run thence N 89' 17' 30" W 35.00 feet; thence N 01' 40' 57" E 20.00 feet; thence S 89' 17' 30" E 35.00 feet; thence S 01' 40' 57" W 20.00 feet to the point of beginning It is understood by the undersigned that, by acceptance of this dedication, the City of Fort Collins accepts the duty of maintenance of the sanitary sewer line located within the easement and shall restore the surface to its original condition subsequent to any necessary maintenance of the sanitary sewer line, however, the City of Fort Collins does not accept the duty of maintenance of the surface land described in the easement except as specifically set forth above.
