EASEMENT DEED
KNOW ALL MEN BY THESE PRESENTS: That the undersigned,
SODTHMOOR VILLAGE EAST, a Colorado non-profit corporation f/k/a
SECOND AND THIRD FILINGS HOMEOWNERS' ASSOCIATION, being the owner
of a certain real property in Larimer County, Colorado legally
described at Book 2058 on Page 185 in the Larimer County Records,
in consideration of Ten Dollars ($10.00) in hand paid, receipt of
which is hereby acknowledged, and other good and valuable
consideration does hereby grant, sell and convey to the City of
Fort Collins, Colorado, for public use forever a permanent easement
for a bicycle/pedestrian path in the City of Fort Collins, County
of Larimer, State of Colorado, more particularly described on
Exhibit "A" attached hereto and by this reference made a part
hereof. In addition to the above consideration, the City agrees to
resod the existing area currently being used for a pedestrian path
not later than September 30, 1996.
By acceptance of this dedication, the City of Fort Collins
accepts the duty of repair and maintenance, including necessary
snow removal, of such easement.
Furthermore, by acceptance of this dedication, the City of
Fort Collins agrees to indemnify and hold the undersigned harmless
from and against all claims, liability, expenses (including
attorney's fees), loss or damage arising directly or indirectly
from the City's negligent performance or non-performance of its
repair and maintenance obligations referenced above to the extent
permitted by law and the Charter of the City of Fort Coll*s.

DESCRIPTION
A permanent easement No. PE-1 the City of Fort Collins, Colorado, Project No. STM M455-006,
containing 7,322 square feet, more or less, being a portion of Tract H, REPLAT OF LOTS 119 THRU
144 AND LOTS 315 THRU 323 OF SOUTHMOOR VILLAGE EAST, THIRD FILING, a plat which is
on file in the Larimer County Clerk and Recorders Office in Book 1862 on Page 952, on December
29, 1977, situated in the Southeast Quarter of Section 30, Township 7 North, Range 68 West, of the
Sixth Principal Meridian, Larimer County, Colorado, said permanent easement being more
particularly described as follows:
Commencing at the northeast corner of said Tract H; Thence South 00-04'16" East, along the
east line of said Tract, a distance of 54.66 feet to the POINT OF BEGINNING;
Thence South 00°04'16" East, continuing along said east line, a distance of 373.71
feet;
2. Thence South 89°55'44" West a distance of 25.00 feet;
3. Thence North 00°04'16" West a distance of 100.00 feet;
4. Thence North 05-17'05" East a distance of 96.42 feet,
5. Thence North 00°04'16" West a distance of 163.63 feet to a point of curvature;
Thence along the arc of said curve to the left having a central angle of 30-09'12",
(a chord bearing North 15°09'06" West, a chord distance of 3.64 feet), a radius of
7.00 feet, an arc length of 3.68 feet to a point on the north line of said Tract H, said
point being a point of curvature not tangent with the previous curve;
Thence along said north line and along the arc of said curve to the left having a central
angle of 07°19'37", (a chord bearing North 25°23'39" East, a chord distance of 17.12
feet), a radius of 134.00 feet, and arc length of 17.14 feet,
