UTILITY EASEMENT DEDICATION
KNOW ALL MEN BY THESE PRESENTS: That the undersigned, being the

RESOLUTION NO. PZ95-16
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE 30 FOOT WIDE
UTILITY EASEMENT LOCATED ON LOT 1 OF THE
PARK SOUTH COMMERCIAL PLAZA MINOR SUBDIVISION
WHEREAS. Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements and rights -of -way, by resolution or by
approval of replats containing notation of such vacation; and
WHEREAS., the Owner of Lot I of the Park South Commercial Plaza Minor
Subdivision has requested the vacation of a 30 foot wide utility easement more particularly
described below; and
WHEREAS, the Owner is relocating the existing sanitary sewer within the easement to
a new easement which has been dedicated to the City by separate document; and
WHEREAS, due to the relocation of said sanitary sewer, the original utility easement
proposed for vacation is no longer necessary to retain for such purposes; and
WHEREAS, all public and private utility agencies have been notified of the vacation
request and report no objections.
NOW, TI IEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that the easement area described as follows, to wit:
A 30.00 foot wide utility easement situate in Lot 1, Park South Commercial Plaza
Minor Subdivision, City of Fort Collins, County of Latimer, State of Colorado, the
centerline of which begins at a point which bears N89 42'4511W 107.00 feet and again
S00 00'00'E 245.00 feet from the Northeast corner o1' said Lot 1 and runs thence S00
00'00"E 711.31 feet
be and is hereby vacated; UPON THE CONDITION THAT this vacation shall not take effect
until the existing sanitary sewer line within said easement area has been relocated and said
relocated sanitary sewer line has been accepted by the City; and the City has caused an
affidavit giving evidence of said relocation and acceptance to be duly recorded with the
Larimer County Clerk and Recorder..
