DEED
FOR CONVEYANCE OF FACADE AND GRANT OF
MAINTENANCE EASEMENT FOR FACADE REGARDING THE LINDEN HOTEL
The undersigned are the owner and the lienholder of the
following -described real property located in Larimer County,
Colorado:
A portion of Lots 2 and 4, Block 13, in the City of Fort
Collins, Colorado, to wit: Beginning at the Southeas ATEDOCAENTARYFEE
corner of Lot 2 (being the most Southerly corner) in sai
Block 13; thence Northeasterly on line of Linden Street, EXEMPT
75 feet; thence Northwesterly parallel to Walnut Street,
100 feet; thence Southwesterly parallel to Linden Street
75 feet; thence Southeasterly on line of Walnut Street,
100 feet, to Point of Beginning, COUNTY OF LARIMER, STATE
OF COLORADO
(hereinafter referred to as the "Linden Hotel"). The street
address of the Linden Hotel is 201 Linden Street, Fort Collins,
Colorado 80524. m
The undersigned, for and in consideration of the sum of ten
dollars ($10.00) in hand paid, do hereby sell and convey, in a "
accordance with the following terms and conditions, to The Fort "
Collins Downtown Development Authority, a body corporate and
politic (the "DDA"), their respective interests in and to that `��" z
portion of the Linden Hotel constituting the facade of the Linden
Hotel as hereinafter defined, reserving unto the Grantor hereof an
access easement over and across such facade for maintenance z
thereof. The undersigned do hereby further grant and convey an "
easement over and across that portion of the Linden Hotel
reasonably necessary for maintenance of such facade. o
1. Facade
The facade referred to herein is legally described as follows:
A portion of Lot 2 and Lot 4, Block 13, Town of Fort
Collins, Larimer County, Colorado. Being more
particularly described as follows:
Considering the Northwesterly Right-of-way line of Linden
Street as bearing N 41010' E as determined by a cross
chiseled on 7.0' offsets from said Right-of-way and nails
set in concrete on 7.0' offsets from said Right-of-way
and with all bearings contained herein relative thereto.
Commencing at the most Southerly corner of said Lot 2;
thence N 41010' E along the Southeasterly line of said
Lot 2 7.8 feet to the TRUE POINT OF BEGINNING; thence
continuing along said line N 41010' E 67.5 feet; thence
departing from said line N 48050' W 1.6 feet; thence S
41010' W 7.4 feet; thence N 71005' W 2.7 feet; thence S
41010' W 6.3 feet; thence S 26035' E 2.7 feet; thence S

11.0 feet more or less to the TRUE POINT OF BEGINNING,
together with an easement for the maintenance of the
Linden Hotel facade as more fully described in that
certain Agreement recorded April 27, 1994 at Reception
No. 94036314, COUNTY OF LARIMER, STATE OF COLORADO (the
"Facade").
2. Maintenance Easements
The easements granted and reserved herein shall be for the
purpose of maintaining the Facade in its present location and for
structural support of the Facade in accordance with that certain
Agreement by and among the DDA, Historic Linden LLC, a Colorado
limited liability company, Mitchell Morgan and David Veldman
recorded with the Larimer County, Colorado Clerk and Recorder on
April 27, 1994 at Reception No. 94036314.
3. Term/Reverter
The term of this Grant shall be for a period of thirty (30)
years, commencing upon execution hereof. At the expiration of such
30-year term, all interests of the DDA in the Facade and in the
maintenance easement shall terminate and title to the Facade shall
thereupon automatically revert to Grantor or its/his successors and
assigns in the Linden Hotel.. It is the intent of this paragraph
that, at the termination of this Grant, title to the Facade shall
thereafter be an appurtenance to and run with the Linden Hotel.
