ACCEPTING AND APPROVING THE PLAT OF WHAT IS KNOWN AS THE
SCHRADER'S FIRST ANNEXATION TO THE CITY OF FORT COLLINS,
COLORADO, AND AUTHORIZING THE ANNEXATION OF ALL THE TERRIT(Jic'
EMBRACED IN SAID PLAT TO THE CITY OF FORT COLLINS AND TO BE
INCLUDED WITHIN THE LIMITS AND JURISDICTION THEREOF, PURSUAN't
TO THE AUTHORITY CONTAINED IN ARTICLE 11, CHAPTER 139, COLORAQct
REVISED STATUTES 1953. --
WHEREAS, heretofore a written petition was presented to the Couaci
of the City of Fort Collins in substantial compliance with the provisi.u❑:a )--
Article 11, Chapter 139, Colorado Revised Statutes, by the sale owners of i:ha
area of land embraced in what is known an Schrader's First Annexation to che-
City of Fort Collins, wherein and whereby said petitioners petitioned the Ci'.:,
of Fort Collins for the annexation of all the territory embraced in wha,. is kilo=-
as Schrader's First Annexation to the City of Fort Collins, Colorado, compris'i:.;
the lands shown in the plat thereof attached to said petition and more: particularl,.
described as hereinafter set forth, and
WHEREAS, said petition was accepted by the Council of the Cit., of
Fort Collins by resolution passed and adopted on August 10, 1961, and
WHEREAS, notice for hearing on the 21st day of September, A. D.
on an ordinance approving the annexation of said territory and including the
same within the limits and jurisdiction of the City of Fort Collins was dulk
published as provided by law, and
WHEREAS, the Council of the City of Fort Collins has found r:hat the
petition and the documents thereto attached meet the requirements of Article 11;
Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS, no proceedings for an election to determine the quesciuit -Z
annexation have been initiated by written counter -petition as provided 3.y 11-1..
and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS;
Section 1. That after due consideration of the petition for ai�nexat,io..,
the petition for the annexation of all the territory in what is known a -id
as Schrader's First Annexation to the City of Fort Collins, Colorado, .a, shr•v„
by the plat thereof annexed to said petition and which is more partictiL r7;
described as follows, to -wits
The North 140 feet of Tract 5, of East Acres, according
to plat filed May 24, 1930, being a subdivision of the
Northeast quarter of the Northeast quarter (,NE} NEk) of
Section 24, Township 7 North, Range 69 West of the 5th
P.H.{ EXCEPT the West 143.55 feet thereof;
be accepted and approved and that said territory be annexed and mad& ri
the City of Fort Collins and be included within the limits and ,jurisdiction,..,'
the City of Fort Collins as a part of "D" Commercial District, end th,%:. ::•,
City Clark be and he is hereby authorized and directed to prepare cer_4iiei
copies of this ordinance, to each of which shall be attached a plait of
Schrader's First Annexation to the City of Fort Collins, Colorado, and
a copy thereof in the office of the Clerk and Recorder of the County ox al ,crt
and another copy thereof in the office of the Clerk of the City of Foxc t:oiii;:r•.
together with a certified copy of said petition and another copy of snit, ;,et:t;_5,.,_
and approving ordinance with the Secretary of State of the State of Colorado.
Section 2. That in accepting and approving the plat of Schrad.ei`,
Annexation to the City of Fort Collins, the City of Fort Collins does not ar,sas
obligations respecting the construction of water mains, sewer lines, ;tact
electric light lines or other services or utilities with respect to ser=,icQ
said addition, except as may be required and provided by the owners of the
property within the limits of said addition in compliance with the term- uno:
provisions of Ordinance No. 70 1929, as amended, relating to local and public
improvements.
