THIS DEED, made this 22nd day of October, 1992, between JOHN
R. PURMA AND MILDRED F. PURMA of the County of Larimer, State of
Colorado, GRANTOR, whose address is 308 Anabel Lane, Fort Collins,
Colorado 80525 and THE CITY OF FORT COLLINS, COLORADO, a Municipal
Corporation, GRANTEE, whose address is 300 LaPorte Avenue, Fort
Collins, Colorado 80521.
WITNESSETH:
That for and in consideration of the covenants and agreements
herein set forth, the sum of THREE HUNDRED FORTY THREE AND 68/100
DOLLARS ($343.68), and other good and valuable consideration in
hand paid by the Grantee to the Grantor, the receipt and adequacy
of which is hereby acknowledged, the Grantor hereby grants, sells
and conveys to the Grantee, its successors and assigns, a perpetual
easement and right-of-way to install, operate, maintain, repair,
reconstruct, replace, inspect and remove, at any time and from time
to time underground public utilties, together with a right-of-way
for access, on, along, through and under all of the hereinafter
described real property situated in the County of Larimer, State of
Colorado, being described more fully on Exhibit "A" attached hereto
and by this reference made a part hereof.
The Grantor further grants to the Grantee:
(a) the right of ingress to and egress from said easements
over and across said lands of the Grantor by means of
roads and lanes thereon; provided, that if any portion of
said lands is or shall be subdivided and dedicated roads
or highways on such portion shall extend to said
easements, said right of ingress and egress on said
portion shall be confined to such dedicated roads and
highways;
(b) the right from time to time to enlarge, improve,
reconstruct, relocate and replace any public
improvements, or other structures constructed hereunder
with any other number or type of public improvements, or
other structures either in the original location or at
any alternate location or locations within said
easements;
(c) the right to install, maintain and use gates in all
fences which now cross or shall hereafter cross said
easements;

EXHIBIT "A"
DESCRIPTION OF A 6 FOOT WIDE PERMANENT UTILITY EASEMENT
A 6 foot wide Permanent Utility Easement located in the Northwest
One Quarter of Section 25 Township 7 North, Range 69 West of the
Sixth Principal Meridian, City of Fort Collins, Larimer County,
Colorado, also located in Lot 1 Block 5 of the Plat of The
Thunderbird Estates Third Filing, a plat of record with the Clerk
and Recorder of the said Larimer County, more particularly
described as follows;
Considering the west line of the said Lot 1 Block 5 as bearing
South 00 degrees 00 minutes 00 seconds West and with all bearings
contained herein relative thereto;
Commencing at the northwest corner of the said Lot 1,
THENCE along the north line of the said Lot 1 and along a
curve to the left having a radius of 880.00 feet, a central angle
of 00 degrees 23 minutes 34 seconds and an arc length of 6.03 feet,
being subtended by a chord of North 83 degrees 56 minutes 12
seconds East for a distance of 6.03 feet to the east line of an
existing utility easement as shown on the said plat and to the TRUE
POINT OF BEGINNING of this description;
THENCE continuing along the said north line, along a curve to
the left having a radius of 880.00 feet, a central angle of 00
degrees 23 minutes 35 seconds and an arc length of 6.04 feet, being
subtended by a chord of North 83 degrees 32 minutes 38 seconds East
for a distance of 6.04 feet to a line which is 6.00 feet (measured
at right angles) east of and parallel with the said east line of
the existing utility easement;
THENCE leaving the said north line, and along the said
parallel line, South 00 degrees 00 minutes 00 seconds East for a
distance of 59.94 feet to the north line of an existing utility
easement;
THENCE along the said north line, North 90 degrees 00 minutes
00 seconds West for a distance of 6.00 feet to the said east line
of the existing utility easement;
THENCE along the said east line, North 00 degrees 00 minutes
00 seconds East for a distance of 59.26 feet to the point of
beginning. Containing 358 square feet.
The above described tract is subject to all easements and rights of
ways now existing or of record.
