WHEREAS, Article II, Section 30 of the Constitution of the State of

Colorado requires that one of the following conditions be met before an
unincorporated area be annexed to a municipality:

1. The question of annexation be submitted to a vote of the
landowners and registered electors of the area to be annexed

and the majority of such persons voting, vote in favor of
annexation; or

2. The annexing municipality receive a petition for annexation
signed by more than 50% of the landowners in the area who
own more than 50% of the land; or

3. The area to be annexed be entirely surrounded by or be

solely owned by the annexing municipality; and

WHEREAS, 100% of the landowners in the Stute Annexation #2 area have
signed a petition for annexation; and
WHEREAS, riot less than one -sixth (1/6th) of the perimeter of the area

to be annexed is contiguous with the City of Fort Collins and a community

of interest exists between the territory to be annexed and the City of Fort
ro
Collins; and the territory to be annexed is urban or will be urbanized in
the near future; and such territory is integrated or is capable of being
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and w
conditions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the o
annexation laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:

Section 1. That the following described property
A tract of land situate in the County of Larimer, State of
Colorado to -wit:
Considering the North line of the NE 1/4 of Section 4, T 6 N, R
68 W, 6th. P.M. as bearing West and with all bearings herein
relative thereto.
Beginning at a point on the Northerly riyht-of-way of Colorado
State Highway No. 68 from which the North 1/4 corner of said
Section 4 bears the following five (5) courses and distances: N
90000'00" E 1485.94 feet; N 18°11'24" W 175.88 feet; N 84"17'22"
E 130.74 feet; N 90"00'00" E 400.00 feet; S 84"17'22" E 201.00
feet; said point also being on the East line of Stute Annexation
No. 1 to the City of Fort Collins and the TRUE POINT OF
BEGINNING; Thence along said Northerly right-of-way line of
Colorado State Highway No. 68 S 88"46'45" E 419.34 feet; thence
departing said Northerly riyht-of way line the following two (2)
courses and distances: S 00"23'00" E 151.07 feet; S 02"17'30" E
2474.85 feet to a point on the West line of that certain parcel
described at Book 2180 Page 0035 records of Larimer County, said
point also being on the Easterly right of -way line of the Fossil
Creek Inlet Ditch; thence along the West line of said parcel and
the Easterly riyht-of-way line of said ditch the following four
(4) courses and distances: N 24°06'00" W 121.48 feet; N 22°43'56"
W 361.70 feet; N 11°51'00" W 873.69 feet; N 27"35'00" W 419.56
feet to a point on the South line of said Stute Annexation No.
1; thence departing said West line of said parcel and the
Easterly right of way line of said ditch along the South line of
said annexation N 77°03'25" E 251.19 feet to a point on the East
line of that certain parcel described at Book 2180 Page 0035,
records of Larimer County, Colorado and on the East line of said
Stute Annexation No. 1; thence along the East line of said parcel
and said Stute Annexation No. 1 the following four (4) courses
and distances: N 38°26'30" W 176.04 feet; N 04°04'30" W 325.00
feet; N 11"45'00" W 164.06 feet; N 43°48'00" W 101.41 feet to a
point on the Southerly right-of-way line of Colorado State
Highway No. 68 and on the East line of Stute Annexation No. 1;
thence departing said Southerly right-of-way line along the East
line of said annexation N 08°35'22" E 194.86 feet to a point on
the Northerly riyht-of-way of said Colorado State Highway No.
68, said point also being the TRUE POINT OF BEGINNING, containing
17.14 acres more or less.
be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the Stute Annexation #2.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning
ordinances of the City.
Introduced„ considered favorably on first reading, and ordered
published this 20th day of August, A.D. 1985, and to be presented for final
passage on the :Uth day of September, A.D. 1985.
