ORDINANCE NO. 7 , 1951
BEING AN EMERGENCY ORDINANCE VACATING A PORTION OF THE A1,LEY IN BLOCK 1,
SWETT?S ADDITION TO TH-E CITY OF FCRT COLLINS, COLORKDO, ACCOR1JING TO
FLAT FILED MACH 91 191.0.
WHEREAS, the plat of Block 1, Swett's Addition to the City of
Fort Collins, Colorado, filed on March 9, 1910, shows an alley opening
on McKinley Street, and
WHEREAS, a portion of said alley has never been opened to
the public and has never been used as an alley, and for many years last
past, has been abandoned and has been closed to public travel, which said
portion of said alley is more particularly described as follows, to -wit:
Commencing at the Northwest corner of Lot 8, Block 1,
Swett's Addition to the City of Fort Collins, Colorado,
running thence: East :along the North side of said Lot 6
to the Northeast corner of said Lot 8, running thence
South along the East side of Lots 8, %, 6, 5 and 4 of
said Block 1 to the Southeast corner of Lot 4 of said
Block 1, running thence East 20 feet along the South
line of said Lot h extended to the East line of said
alley, thence North along the East line of said alley
to the Southeast corner of Lot 9 of said. Block 1,
running thence West along the South line of Lots 9, 10
and 11 0£ said Block 1 to the Southwest corner of said
Lot 11, running thence 6outh 18 feet to the point of
beginning;
AND, WHEREAS, the owners of the lots abutting on said portion
of said alley have petitioned the City Council to cause the same to be
vacated, and
WHEREAS, the City Council is of the opinion that it will be to
the best interests of the City to vacate said portion of said alley.
THEREFORE, BE IT ORDNINED BY THE CITY COUNCIL OF THE CITY OF
FORT COLLINS^
Section 1. That that portion of the alley in Block 1, Swett's
Addition to the City of Fort Collins, Colorado, according to plat filed
March 9, 1910, more particularly described as follows, to -wit:
Commencing at the Northwest corner of Lot 80 Block 10
Swettfs Addition to the City of Fort Collins, Colorado,
running thence° Fas#; Tong the North siae of said Lot 8
to the Northeast corner of said Lot 8, running thence
South along the East side of Lots 8, 70 62 5 and 4 of
said Block 1 to the Southeast corner of Lot 4 of said
Block 1, running thence East 20 feet along the South
line of said Lot 4 extended to the East line of said
alley, thence North along the East line of said alley
to the Southeast corner of Lot 9 of said Block 19
running thence West along the South line of Lots 9, 10
and 11 of said Block 1 to the Southwest corner of said
Lot 11, running thence South 18 feet to the point of
beginning;
be and the same is hereby vacated, abolished and abandoned.
Section 2: That rights of way or easements are hereby
reserved for the continued use of existing sewer, gas, water or similar
pipelines and appurtenances, and for electric, telephone and similar lines
and appurtenances.
Section 3: In the opinion of the City Council an emergency
exists for the preservation of the public health, peace and safety, and
this ordinance shall take effect upon its passage under and by virtue of
the authority contained in Sections 6 and 7 of Article IV of the City
Charter.
Introduced, read at length, and adopted by the unanimous vote
of all members of the City Council, at a regular meeting held this 7t+1
day of September, A. D. 1951.
