Dear Rex:
This letter is a follow up confirmation of our phone discussion yesterday
regarding your request to postpone the street improvements on Overland Trail.
We received the cost estimate from Flatiron Paving Company to complete all
improvements as shown on the utilities plans.
We do not feel that the street improvements associated with Lot 3 Phase I
impose an unreasonable burden on this development, and we feel the improve-
ments should be completed with Phase I of Lot 3, as written in the Development
Agreement dated October 12, 1984, for the following reasons:
(1) The Street Oversizing Fund is able to reimburse the
Developer for the city's share of the cost based on
the submitted estimate.
(2) The curb, gutter, and street improvements for Over-
land Trail have been completed to the south of this
development and pavement improvements north of Pro-
spect Street are to be completed by the Overland
Trail Farm Subdivision.

am requesting that you change the utility agreement of the
Prospect -Overland P.U.D. to allow the Overland Trail improvements
to be accomplished with the sixth phase of construction. It is
understood that I will be required to provide a letter of credit,
bond or some other financial vehicle to insure the City that these
improvements will be done by the construction of the sixth phase.
The money for the improvements will be based on 125% of 1/6th of
the total cost to construct the improvements, divided equally per
phase of construction. I propose that the figures below be used as
the basis for determining the total cost of construction.

This is regarding the plates on the storm water chases Wider the sidewalk
adjacent to Overland Trail in the Prospect/Overland P U D., Fort Collins,
Colorado. Mr. Rex Miller, the owner of the property, constructed the
chases narrower than shown on the Utility Plans. The width of the chases
is 9 1/4 inches. The 3/8 inch galvanized plate will carry a H-20 loading.
This should be satisfactory since both chases are set back from the curb
and will not likely have any heavy traffic driving over them. The 3/8
inch plate with a 9 inch span is equivalent to a 5/8 inch plate with
a 24 inch span. This data is from the American Institute of Steel
Construction Manual.
