Dear Mark,
As we discussed today, enclosed is a check to the escrow funds for the right of way for
the Saturn building on South College Ave. There are two different areas that will be
dedicated to the city as right of way. The first is approximately 90 square feet, and the
second is approximately 552 square feet for a total of 642 square feet.
I have spoken with Ron Mills and we have decided that $10.00 a square foot is a fair
amount for the land in the right of way. Therefor check totals $6420.00.
We hope to have attorney's certification for the right of way done by Friday the 23`d of
June.

This memo is to acknowledge the receipt of development bond funds in the amount of
$6,420.00 to guarantee the dedication of easement and right-of-way as required with
the approval of the minor amendment for this development.
When the appropriate deeds of dedication for right-of-way and easement have been
received by the Engineering Department, the funds in the development bond will be
released to you.

$7,845.00 to guarantee the completion of all public improvements to be constructed as
shown on the plans for the development.
When improvements are completed, please call our inspection recorder at 221-6609
to request an inspection (please allow 24 hours for the inspection to take place).
Once the improvements have passed inspection, the funds in development bond will be
released to you.

As we indicated in the Utility Agreement for Southmoor Villaee Fifth
Filing, Lots "T"_and "lam" (otherwise known as Foothills Plaza North P.U.D.)
and in our previous conversation, a bond in tt e amount of $6,25U.0U is required
for your share of the cost of the signal installation. This is necessary
because of the timing situation involved in justifying the signal to the
Highway Department, obtaining traffic counts for the justification, etc.
We would prefer a bond because it is the simplest means to handle it
administratively. However, if you want to explore other means of securing
this obligation, please check with Art March.
This should he resolved shortly so that the City Clerk may approve
the Utility Agreement and file the plat.
