College Avenue. The 25,000 square foot site presently contains an abandoned service station complex which includes a service station structure, asphalt parking areas, and some landscapping. The proposed P.U.D. would in general reduce the impervious areas. As the letter notes, the City is currently reviewing a development proposal to expand the Inn. As part of the financing agreements for that addition, Mr. Konkel is requesting, on behalf of the lender, United Bank, copies of the development agreements related to the project and confirmation that the owner/developer has properly complied with all provisions of those agreements and other "requirements of the City of Fort Collins with respect to the development of the EXISTING Helmshire House Inns project as well as the proposed addition". As you are aware, the full amount of required use tax was not collected on the building permit for this property. Does this request by United Bank and the request for confirmation on compliance with the City's necessary requirements give us the opportunity to collect additional use tax retroactively? I realize it was an error on our part and not a conscious act of Mr. McCabe's, so my intent is not to penalize him but to make the correction, if possible. I would appreciate your help with this request. I have called Mr. Konkel to advise him that we are preparing a response this week. Please forward your information to me as soon as possible. Phase 2 I had Dave Stringer check Helmshire House for any public improvements left incomplete with Phase I. The only item left incomplete was that the alley was paved deleting a required pan down the center. Harry had given Dave a letter stating that it would be constructed by June 15, 1985. This was required as a condition of the CO and has not been complied with. As a result we will require it prior to the issuance of the building permit on any future phase. The original Phase two had no public improvements and there was no development agreement, but with the new Phase 2 and required improvements we will require one. P0521 Amended plan to delete permanent residence and renlacinq it with 5 additional rooms. Located on the east side of College Ave., south of Edwards Ave. 1. A concrete pan down the center of the alley is required before further work is done. 2. Traffic had a concern over employee parking. An additional four spaces may be needed. Staff resolved that an agreement could be reached between the City and the applicant, which would require the applicant to provide the parking spaces at a future date, if it is determined at that time that the spaces are needed to avoid offsite (on -street) parking conflicts. 3. CDBG should be contacted to see if they want to move the house which is on site. 4. The variance to storm drainage detention needs to be amended. 5. More landscaping would be desirable in the area of the alley. The 3/4" water line which is to remain is not adequate to serve the building. No looping of service will be allowed. 3. The Fire protection systems in the existing building must be extended to protect the proposed building. 4. A new Development Agreement is required. 5. Note #5 should be changed to delete section reading, "caused by construction of the Helmshire House", and the word "repaired" should be changed to "replaced". 6. The alley must be repaved to accomodate the drain pan, which must be installed prior to the issuance of a building permit. 7. If it is determined that additional parking spaces are needed at a future date, the applicant shall install such spaces within three (3) months of being notified of such need. The State Division of Highways commented on the need for closure of curb cuts on College Avenue, and the impact of highway traffic noise. Proper safety measures must be provided during curb reconstruction work. Noise insulation of the building walls, including double -pane windows, should be provided to help reduce the impact of traffic noise. To assure that they will be completed with this phase, we are requiring that they be completed prior to the issuance of the building permit. The alley was not paved according to the plans on file with the first phase. The City gave Mr. McCabe the date of June 15, 1985 by which to complete said improvements. This was to allow him to proceed with the opening of his business until the weather would permit the paving to be corrected. Since it has not yet been completed to the City's satisfaction using a deadline to require the improvements and because it will be the only way for vehicles to access the property, we are requiring the alley be completed prior to the issuance of the building permit. I have attached all correspondence regarding this matter. The abandonment of three water services at the main was requested at preliminary stage for Phases One and Two but was not followed up on the final for Phase One. As it turns out, abandoning all services at one time (phases 1 & 2) makes more sense from both the City's point of view and probably the Developer's. This way College will only have to be shut down once for a short period of time rather than twice in a year. Also from the Developer's point of view it would be more economical to do them all at once. City Code requires that the water system be installed as required prior to the issuance of any building permit, so we are just clarifying the requirement of the Code in this particular case. These letters and memos concern the concrete alley pan and other items which were not installed or corrected by the developer in accordance with the development agreement or Utility plans for this development. The building was issued a temporary Certificate of Occupancy on March 7, 1985 based upon the developers written commitment to complete and correct the public improvements, (T C O was extended to September 15, 1985.) These improvements were not corrected in the time frame specified and when the Helmshire House Phase II was submitted for P&Z approval a new Development Agreement was drawn up which required the completion of the improvements from the original development. It is an existing bed and breakfast establishment that is adding 1000 square feet of asphalt parking. There is some interior remodeling that is also being done. The site drains from Southwest to Northeast. College Avenue has a high point in this block and drains both North and South. There is a catch basin in the College Avenue gutter at the Edwards Street corner. It accepts only College Avenue runoff, and I believe the storm drain flows back South to Pitkin Street. There does not appear to be any storm water overtopping of College Avenue at this intersection. Edwards Street drains East in the South gutter. The alley drains from South to North in the inverted crown of the existing asphalt. The main parking area has an inverted crown that drains from West to East and flows North in the alley to the Edwards Street gutter. The existing asphalt parking spaces on both sides of the alley drain to the center of the alley. It is proposed to construct the six new parking spaces so that they also drain to the centerline of the alley. The existing site does not have any offsite drainage entering it other than the alley flows entering from the South. The runoff from this site does not flow onto any private property. The entire runoff flows to the Edwards Street south gutter. The existing site does not have onsite storm water detention. The proposed additional asphalt parking develops 0.10 cubic feet per second of runoff in a ten—year storm. Because of the very small increase of runoff and no practical means of detention, we are requesting a variance to the onsite detention requirement. When the 1000 square feet is stripped of topsoil, it will be lower than the alley asphalt and, therefore, not cause silting onto the alley. However, let it be understood that the City does require the owners of this property to install the concrete "V" pan as shown and approved on the Helmshire House utility plans. College provided that the conditions as stipulated in your letter of February 25, 1985 were met, with the exception of the installation of the alley pan; this was delayed until June 15, 1985. As of this date, the installation of the concrete alley pan, the request for encroachment, or the cleanup of the sidewalk, street, and gutter have not been completed. Please be informed that until such time as the conditions we have discussed per my letter to you dated March 7, 1985 have been met, the permanent Certificate of Occupancy will not be issued. In my opinion, the City has been more than patient in this matter. However, it is now time for the necessary work to be completed in a timely manner. Enclosed is an encroachment application form, a copy of my March letter, and a copy of your letter from February 1985. The intent of this letter is to clarify the City Engineer's position in this matter and to eliminate any misunderstanding as to our intention of using the Certificate of Occupancy process to ootain the public improvements as approved on the Helmshire House PUD utility plans.
