WHEREAS, on October 6, 1998, the Council adopted Ordinance 161, 1998, for the purpose

RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
Ordinance No. 161, 1998, vacates the street rights -of -way for Elk Drive and Otter Road. The rights -
of -way for these streets are not needed as this area is planned as a business park with internal drives,
not streets. Elk Drive has been built and is planned as an access drive, but would not be considered
a public street. The vacation of these streets was prompted by the submittal of two development
proposals in this area, Horsetooth East Business Park PUD, 2nd Filing and Horsetooth East Business
Park PUD, 3rd Filing. Since there are currently utility and drainage facilities within the street rights -
of -way, a utility and drainage easement will be retained. In addition, an emergency access easement
will be retained to provide emergency access into the site. This will remain until the necessary
emergency access easements are platted and will correspond to the proposed driveways. The
existing emergency access easements will then be vacated as appropriate on the platting property.

FOR ELK ROAD AND OTTER DRIVE AS DEDICATED ON
THE SOUTH COLLEGE TECH CENTER, FIRST FILING AND
THE SOUTH COLLEGE TECH CENTER, SECOND FILING
WHEREAS, the plat for South College Tech Center, First Filing and the plat for the South
College Tech Center, Second Filing dedicated to the public rights -of -way for Elk Road and Otter
Drive; and
WHEREAS, the Planning and Zoning Board is considering a final plan for a project entitled
"Horsetooth East Business Park PUD, 2nd Filing, Pad G", which replats a portion of Lot 8A and said
rights -of -way; and
WHEREAS, the approval of the Horsetooth East Business Park PUD, 2nd Filing, Pad G
requires the vacation of the rights -of -way dedicated for Elk Road and Otter Drive more particularly
described on Exhibits "A" and `B", attached hereto and incorporated herein by this reference; and
WHEREAS, said portions of the Elk Road and Otter Drive rights -of -way are no longer
necessary or desirable to retain for street purposes as they will serve as internal drives for the
business park and not as public streets; and
WHEREAS, pertinent City agencies and private utility companies have been contacted and
reported no objection to the proposed vacation, provided that an easement for utility, drainage and
emergency access be reserved unto the City; and
WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said street rights -of -way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portions of street rights -of -way more particularly described on Exhibits "A" and
"B" are hereby vacated, abated and abolished, reserving the same unto the City as an easement for
utility, drainage and emergency access purposes.
Introduced, considered favorably on first reading, and ordered published this 15th day of
September, A.D. 1998, and to be presented for final passage on the 6th day of October, A.D. 1998
