Reference: Settler's Creek PDP — Variance request for driveway separation on an
arterial street
Dear Ms. Moore:
The intent of this letter is to request a variance for the distance between the proposed access
drive for the above referenced project and the existing access drives serving the adjacent
properties. The distance between the access drive for the proposed development and the
existing access drive to the north is approximately 245-feet, which is less than the distance
required by the "Larimer County Urban Area Street Standards, January 2, 2001" edition. The
length required is 460-feet between the centerline of driveways along a 4-lane arterial
roadway. This standard is found in Table 7-3 on Page 7-7 of the design criteria.
Support for the variance described above is discussed in the line items listed below:
1) The proposed access drive has been located so the through lanes align with the
through lanes of the future Pavilion Drive improvements.
2) The existing drive to the south that currently services the Home Depot is located
approximately 550-feet from the proposed access drive. If the proposed access drive
were shifted south to provide 460-feet to the access drive to the north, only 335-feet
would be provided to the existing Home Depot access drive. Therefore, any location
of the proposed access drive along the JFK Parkway frontage would require a
variance.

RE: Settler's Creek PDP — Revised variance request for driveway separation on
an arterial street
Dear MS. Moore:
The intent of this letter is to request a variance for the distance between the proposed
access drive for the above referenced project and the existing access drives serving the
adjacent properties. The distance between the access drive for the proposed development
and the existing access drives, servicing the Parkway Town homes and the Reflections
Senior Apartments to the north, are approximately 230-feet and 245-feet respectively. In
addition, the proposed access drive is located approximately 430-feet north of the
existing access drive that services the existing King Soopers. These aforementioned
distances are less than the distance of 460-feet required between the centerline of
driveways along a 4-lane arterial roadway by the " Larimer County Urban Area Street
Standards, January 2, 2001" edition, This standard can be found in Table 7-3 on Page 7-
7 of the aforementioned design criteria.
Support for the variance described above is discussed in the line items listed below:
1) The proposed access drive has been located so the through lanes for the subject
site are no more than 2' offset from the through lanes of the future Pavilion Lane
improvements.
2) The existing drives to the south that currently service the Home Depot and King
Soopers are located approximately 550-feet and 430-feet respectively from the
proposed access drive. If the proposed access drive were shifted south to provide
460-feet to the access drive to the north, only 320-feet and 200-feet would be
provided to the existing Home Depot and King Soopers access drives
respectively. Therefore, any location of the proposed access drive along the JFK
Parkway frontage would require a variance.
3) As mentioned previously, the proposed access drive has been aligned with the
future Pavilion Lane and JFK Parkway intersection to minimize traffic conflicts in
the vicinity of the subject site. Consequently, a driveway separation similar to
that provided by the intersection has been provided. The proposed driveway

location is the best location available for the project site based on the existing
driveway locations and the proposed pavilion lane alignment. It is not anticipated
that any public health, safety, and/or welfare problems will be created by the
proposed driveway design.

Attached please find an I I" X 17" drawing entitled "Combined Access Exhibit" dated
October 21, 2004 for the above referenced project. As requested by the City, our office
has prepared this exhibit to depict a possible design scenario for a combined access that
would serve the subject site and Home Depot and alleviate the existing conflict between
the existing King Sooper and Home Depot access drives.
To prepare the attached design our office made the following assumptions:
• The proposed combined access drive must align with the existing King Sooper
access drive.
• Home Depot truck deliveries would utilize the combined access drive.
• A WB-67 truck, typical delivery truck utilized for a home improvement
warehouse, would have to be able to safely navigate the access drive.
• Deliveries would come from 1-25, west along Harmony Road, and north along
JFK Parkway.
The intent of this design is to minimize the impacts to the site layout and the existing
Home Depot while providing a combined access. Although our office made every effort
to achieve this design goal, the following concerns still remain:
• 26 stalls and one garage would be lost on -site and 11 stalls would be lost on the
Home Depot site due to this design.
• Access drives would intersect at irregular angles and on -site traffic circulation
would be negatively impacted.
• The combined access would negatively impact pedestrian circulation between the
subject site, JFK Parkway and King Soopers.

• Access to the Home Depot via the combined access drive would be indirect and
awkward. This may confuse motorists, which could negatively impact traffic
circulation both on -site and on JFK Parkway.
• Home Depot patrons utilizing the combined access may gravitate to the parking
located on the subject site and not proceed to the parking stalls provided by Home
Depot. This would reduce the amount of parking available to residents and
unnecessarily increase on -site traffic circulation.
• Truck traffic would be forced to travel through a residential area. This could lead
to conflicts with pedestrian, bicycle and passenger vehicle traffic. In addition,
noise and truck exhaust may irritate residents especially during the morning and
evening hours.
• The truck route would become awkward and indirect and more difficult to
navigate than what exists today.
In addition, please note that relatively few northbound vehicles enter the northerly King
Soopers driveway. This is primarily due to the location of the drive relative to Harmony
Road and the extended entry drive length making it inconvenient for patrons to access the
overall shopping center. It is the opinion of this office that the majority of the vehicles
traveling from Harmony Road enter at the main central entrance. Due to this reduced use,
entry left turn conflicts are minimal.
