ORDINANCE NO. 141, 1996
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF THE RIGHTS -OF -WAY
FOR BATTLECREEK DRIVE AND WHITE WILLOW DRIVE
AS DEDICATED ON THE WILLOW SPRINGS PUD PLAT
WHEREAS, the plat for Willow Springs PUD dedicated to the public rights -of -way for
Battlecreek Drive and White Willow Drive which included dedication of rights -of -way for future
street intersections; and
WHEREAS, the Current Planning Department has approved an administrative change to
Willow Springs PUD, Phase I entitled "The Villages at Willow Springs PUD" that replats Tract A
of the Willow Springs PUD, which abuts said rights -of -way for Battlecreek Drive and White Willow
Drive; and
WHEREAS, the approval of said administrative change requires the vacation of certain
portions of the original rights -of -way dedicated for Battlecreek Drive and White Willow Drive more
particularly described on Exhibits "A" and "B", attached hereto and incorporated herein by this
reference; and
WHEREAS, said portions of the Battlecreek Drive and White Willow Drive rights -of -way
are no longer necessary or desirable to retain for street intersection purposes due to the use of private
driveways and the platting of new building envelopes associated with the Villages at Willow Springs
PUD; and
WHEREAS, pertinent City agencies and private utility companies have been contacted and
reported no objection to the proposed vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said rights -of -way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portions of street rights -of -way for Battlecreek Drive and White Willow Drive,
more particularly described on Exhibits "A" and "B", attached hereto and incorporated herein by
this reference, are hereby vacated, abated and abolished.
