ORDINANCE NO. 64, 1998
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
TAVELLI ELEMENTARY SCHOOL 2ND ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Resolution 98-49, finding substantial compliance and initiating annexation
proceedings, has heretofore been adopted by the Council of the City of Fort Collins; and
WHEREAS, the Council does hereby find and determine that it is in the best interests of the
City to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the following described property, to wit:
A tract of land situate in the Southwest'/4 of Section 31, Township 8 North, Range
68 West of the Sixth P.M., and in the Southeast %4 of Section 36, Township 8 North,
Ranee 69 West of the Sixth P.M., County of Larimer, State of Colorado, which,
considering the West line of the said Southwest'/4 as bearing S00°06'00"W and with
all bearings contained herein relative thereto, is contained within the boundary lines
which begin at a point on the West right-of-way line of North Lemay Avenue which
bears S00°06'00"W 370.00 feet, and again N90°00'00"W 30.00 feet from the West
'/4 Corner of said Section 31, and run thence N90°00'00"E 541.23 feet; thence
S00006'00"W 685.00 feet; thence N90°00'00"W 461.23 feet to a point on the East
right-of-way line of North Lemay Avenue; thence along said East right-of-way line,
SOW06'00"W 373.05 feet to the Southeast Corner of the Tavelli First Annexation;
thence along the Easterly boundary line of said Tavelli First Annexation,
N07°57'58"W 356.35 feet to a point on the West line of said Southwest Y4; thence
along the Westerly boundary line of said Tavelli First Annexation, S00°06'00"W
246.00 feet, and again S43 ° 12'41 "W 73.16 feet to a point on the West right-of-way
line of North Lemay Avenue; thence along said West right-of-way line,
N00006'00"E 724.55 feet; thence S89°54'00"E 20.00 feet to a point on the West
right-of-way line, N00°06'00"E 279.95 feet to the point of beginning, containing
9.2588 acres, more or less.
be, and hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as
the Tavelli Elementary School 2nd Annexation.
Section 2. That, in annexing said property to the City, the City does not assume any
obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines,
streets or any other services or utilities in connection with the property hereby annexed except as
may be provided by the ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section 37-45-136(3.6), C.R.S., to the
inclusion of said property into the Municipal Subdistrict, Northern Colorado Water Conservancy
District.
