Marc,
We are coming up with more detailed utility layout issues but this is
not a big surprise. The question is related to the timing of our next
coordination meeting. We're pretty comfortable with the horizontal
layout of water, sanitary and storm for the PDP although the widths of
those easements are a concern.
If the location of dry utilities is a concern to you for the PDP I'm
wondering if we can get on the agenda for next week's meeting. If that
falls more in the FDP area we can wait for our next coordination meeting
until the plans progress further, but I suspect we will get some
comments from the dry utility companies.
The emergency access and utility easement is pretty well defined as is
the lot line between the commercial and residential. However, the other
utility easement widths and locations need work. The PDP checklist
basically requires the plat to be 100% complete with the exception of
curve data. I'm concerned about having our surveyor spend the time and
money to tie all the easements down only to have them shift. Even if
they only move a foot it's an issue with the legal ties. I'm trying to
be sensitive to your ability to recommend the PDP goes to the hearing
officer. Will you require all the onsite easements to be tied down
precisely with the PDP??

Seeing Eric's response regarding Harmony and Shields, yes, with the B03
measuring passing, the improvements to Harmony and Shields will be addressed.
Also with regards to the repay question — The developer is required to repay
the City for the cost of constructing the improvements to Harmony and Shields
abutting the site which was part of the original realignment to Harmony Road
connecting with CR 38E that Matt Baker constructed.

Subject: Review Time (Innovation Island)
Jennifer, since I was unable to get a hold of you today, and I will be out of
the office until Tuesday, let me give you a rough overview of the review time
required. Each round of plan review takes us 2 weeks (the reviews are held on
Wednesdays just like the initial review process). Looking at my comments, I
personally won't need more than one round unless something is dramatically
changed, but I can't vouch for other departments. another 2 weeks are
required to get the mylars routed and signed. The Development Agreement is
typically done after the final plans are ready for signature (can usually be
done concurrently with mylar routing, and if everything goes smoothly with it,
can take as little as 2 weeks to complete. The Development Construction permit
is dependent on 3 things- letter of credit or development bond for the amount
of public infrastructure improvements, the paid erosion control deposit, and
the paid inspection fees. We typically hold a DCP meeting around the time the
mylars are signed to go over the project with the project engineer,
contractors and city staff. No actual permit may be issued until the plans,
plat, and DA are filed. As we get closer to working on the DA and DCP, I can
send you some information sheets and templates to help you along.

They can phase it and provide only an escrow for a given phase. However, in
order to do that, their landscape plan must show the phasing lines. If it
doesn't, they'd have to come in later and do a minor amendment to add phase
lines.

Peter, I just wanted to bring to your attention, a note on the Innovation
Island Landscape Plan. Note 6 has a line that says "The escrow for such
landscaping may be phased, including landscaping associated with street trees
indicated for planting in public ROW in the front of side of a residential
lot." I don't know how you guys usually do the escrow on the landscaping
requirements, but I thought I had heard at some point on this project when
residents were voicing some concerns, that the escrow was all done up front,
but the actual installation could be phased with the buildings. It just
struck me as an odd note.

The project meets the City's definition for affordability and qualifies for Priority
Processing and a 100% waiver of its Development Review Plan Fees. The waiver only
applies to fees charged by the Current Planning Department.
Please implement Priority Processing procedures for this project in the development
review process. The developer will be submitting an application for review to the Current
Planning Department on Wednesday, October 4, 2005.

Dear Don:
Please consider this a Variance Request for the utility easement along the west side of the proposed
Innovation Island development along South Taft Hill Road. In particular, we request a variance to
reduce the 15-foot utility easement for South Taft Hill Road required by Larimer County Urban
Area Street Standards (LCUASS) for arterial streets.
We are requesting a 9-foot utility easement, 50-feet behind the existing five foot wide sidewalk (55
feet from South Taft Hill Road's flowline). Our justifications areas follows:
1) There is an extra wide right-of-way with 40-feet behind the existing sidewalk and the existing
wet and dry utilities are located within this widened right-of-way.
2) The City of Fort Collins Light and Power representative stated they do not need an additional
easement in this corridor.
3) Comcast, Qwest, and Xcel are able and willing to work within a 9-foot utility easement should
they find the need to relocate their facilities in the future.
4) There is an existing exclusive 10-foot REA easement immediately adjacent to the right-of-way
which in essence provides a 19-foot wide utility corridor.
Therefore, it is concluded that a variance to allow a 9-foot utility easement will not compromise the
health, welfare, and safety of the public. It is respectfully requested that the above variance be
granted.

I'm not real sure where Innovation Island site is located. But we usually can
make the 9' u.e. work, as long as the electric, phone and Comcast stay out of
the u.e. and lay in the road right of way. If we are extending gas main, we
will need to be in the utility easement. If we are install the gas service
from the gas main to the building, we do not need to be in the easement unless
we are cross another lot. Let me know if you need further information. Thanks

I wanted to check with you to make sure that XCEL will be able to work
within a 9' utility easement as opposed to our standard 151. (This is
on the west side of the Innovation Island site, along Taft Hill). The
engineer has asked for a variance request for this and said that XCEL,
Qwest, and Comcast were all fine with the 9 feet. Please just let me
know if you have any issues with it. The other thing I wanted to check
in on was whether or not you need an easement for the 2 connections for
the buildings on the Southeast portion of the site. It appears from
their utility plan that they are extending the main through a portion
not in a utility easement. If you have any questions, feel free to give
me a call.

Sight Distance Variance Request

Please consider this a Variance Request for the sight distance requirement at the intersection of
West Harmony Road and the proposed and future entrances to the Innovation Island
development. In particular, we request a variance to reduce the 835-foot comer intersection sight
distance for a design speed of 45 MPH required by Larimer County Urban Area Street Standards
(LCUASS) Figure 7-16, dated 9/11/00.
We are requesting a 610.5-foot intersection sight distance turning left and 430-foot intersection
sight distance turning right onto West Harmony Road. Our justification for the decrease in the
intersection sight distance is based upon the fact that the Larimer County Urban Area Street
Standard (LCUASS) Figure 7-16 is from "A Policy on Geometric Design of Highways and
Streets 1990" by the American Association of State Highway and Transportation Officials
(AASHTO) and the requested values have been updated from "A Policy on Geometric Design of
Highways and Streets 2001" by AASHTO. In addition, pursuant to conversations with the city
traffic engineer, utilizing this updated criterion is appropriate based on the proximity to the
intersection and the travel speeds associated with this segment of the roadway.
Therefore it is concluded that a variance to allow a 610.5-foot intersection sight distance turning
left and 430-foot intersection sight distance turning right onto West Harmony Road will not
compromise the health, welfare, and safety of the public. It is respectfully requested that the
above variance be granted.

on the west side of the site, along Taft Hill). The engineer has asked
for a variance request for this and said that XCEL, Qwest, and Comcast

lines shown in this in this area, but please just let me know if you
have any issues with it. Right now, it appears there is gas service
running through, but that is all.

the north access location on Harmony Rd.
Dear Bob,
This letter is in response to the variance request dated October 5, 2005, to reduce the sight
distance requirements at the intersection of West Harmony Road and the proposed entrance
to the Innovation Island development.
The variance request to reduce the left turning intersection sight distance from 830' to
610.5' and to reduce the right turning intersection sight distance from 830' to 430' has
been granted. With consideration of the proximity of the access location to the Harmony
Road and Taft Hill Road intersection, and your calculation of sight distance based off of
AASHTO's updated methods, our engineering staff and traffic engineer do not feel that the
sight distance standard is applicable in this particular situation.
The granting of this variance request does not set a precedent or change the application of
