Why not use it for the sidewalk and meet the minimum width requirement instead of requesting a modification? If the existing easement is not going to be used, please provide a letter of intent from the owner of the lot to the east that they intend to grant an access easement to the alley lot. This letter must be received prior to scheduling a public hearing, and the easement must be completed prior to final approval of the project. Please review these criteria (attached) and revise the letter accordingly. Documentation of reasoning behind engineering variances is important, especially as regards legal action and liability, and the public health, safety, and welfare. This easement needs to be shown on the plans and dedicated. The easement can be exclusively to Comcast, in which case please work with them regarding that easement, or it can be dedicated as a general utility easement to the City using the City's standard format. Number: 27 Created: 7/11/2005 [7/11/05] Of the 5 easement documents dropped off for review, three were previously dedicated via the Preiss subdivision plat and are existing. The parking easement should be dedicated to Lot 1, not to the City, and the pedestrian access easement, if dedicated to the City, would allow anyone to use it. You may want to dedicate that jointly to Lots 1 and 2, including a clause that it may not be vacated without the approval of the owners of both lots. Or you may proceed with dedicating it to the City as a public access easement. Page 2 Thursday, August 18, 2005 The following items need to be completed before a development construction permit can be issued on the 617 Whedbee, Steve Preiss Residence site (before any construction, grading, utility work, etc. can commence): 1. Need a copy of the recorded parking space deed of dedication. A copy with the Larimer County reception number on the document. 2. Need a copy of the recorded 3 foot wide pedestrian access easement dedication. A copy with the Larimer County reception number on the document. 3. Signed and dated deed of dedication (signed by the property owner and the applicant's attorney) for the dedication of the utility easement for Comcast. You already submitted the legal description for this. I will have that checked and let you know if any changes are needed. 4. Due to the small amount of public infrastructure construction we will not need a public infrastructure security provided for this project. 10. We need to know who your utility contractor is as the General Contractor you have listed is not currently licensed to do work within the right-of-way.
