for the construction of decks within portions of the proposed vacated easement.

NO PROBLEMS
PROBLEMS/CONCERNS AS FOLLOWS:
Comcast Cable will not vacate the 10 foot utility easement. We currently have facilities
in this easement to service the homes.
Comcast will need to have continuance utility easements from lot to lot to keep our
facilities in service.

Subject: easement vacation
Marc,
Recently you sent a request to vacate a portion of a utility and
drainage easement along the full 10' width of the rear property line of
lots 2 through 6 of the Green a Collindale P.U.D.
At this time Qwest has distribution cable running through these utility
easements and my fear is the building footprints and back decks proposed
for these easements will conflict with placed telephone structure. I
have spoken with our ROW agent, Donald Somer (970-350-2922) and he is
unwilling to vacate these easements lest we are forced to move our
structure in the future at Qwest's expense. He also stated that Qwest
would need additional easement granted in place of that which is vacated
