Poudre Fire Authority is being asked to convey to the City an Emergency Access
Easement over a portion of its property described as Lot 1, Block 11 Westchase PUD as a
condition of the above -referenced development on Lot 2, Block 11. The area to be dedicated as
an Emergency Access Easement is currently encumbered as part of a 24 foot wide Access
Easement, approximately 225 feet long, benefiting Lots 1, 2 and 3, as shown on the plat of the
Westchase PUD.
Poudre Fire Authority intends to work with the developer of Lot 2 to dedicate the needed
Emergency Access Easement. However, such dedication is contingent on approval by the
Poudre Fire Authority Board of the conveyance of its property, as well as on the owners of Lot 2
and Poudre Fire Authority reaching a mutually acceptable agreement and entering into a contract
regarding the improvement and future maintenance of the whole of the Access Easement.

Dear Louise:
As promised, this letter is to follow up on our telephone conversation Wednesday regarding the
24 foot shared access easement located between Lot 1 and Lots 2 and 3, Westchase P.U.D. here
in Fort Collins, and your need for Poudre Fire Authority (PFA) to dedicate to the City of Fort
Collins an emergency access easement over a portion of PFA's side of the existing easement on
Lot 1 as part of your development of Lot 2.
Just for background, I would like to explain that Poudre Fire Authority is a separate legal entity
from the City of Fort Collins, although through an agreement it provides the City's fire
protection services. This office provides legal services to both the City and PFA, however in this
matter I am representing only PFA as the owner of Lot 1, not the City of Fort Collins.
PFA staff intends to dedicate the emergency access easement that is needed for your
development, and we are preparing a Letter of Intent to meet your development review
requirements. The letter will specify that the actual dedication will be contingent on approval of
the property conveyance by the PFA Board of Directors, and contingent on you and PFA
reaching an agreement and entering into a contract regarding the completion of paving of the
shared easement and how future costs for maintenance of the easement area will be divided. As I
mentioned on the phone, I've asked PFA to provide me with some numbers that we can use for
discussion.
