Additionally, I understand that a 50- foot buffer as measured from the top of the bank for New Mercer Ditch will not be required on the north side of the ditch where there will be a 20 foot ditch maintenance road between the developed area and the ditch bank. As I indicated to you, as a result of meetings between both Glen Schlueter (Storm Water Department) and Dave Averill (Transportation Department) and myself to discuss this project, my current intent is to dedicate to the City the entire five (5) acre floodplain/ floodway portion of this property on the south side of the ditch to accommodate a City bike trail and a regional storm drainage channel. A "temporary" detention pond associated with this project will also be in this south portion and be replaced by the channel in the future. Any non-native vegetation that is removed as part of the construction of this detention pond will be restored with native vegetation. Support for the variance described above is discussed in the line items listed below: 1) Preliminary discussions with the various utilities have shown no need for the easement in that area and they have given their verbal approval based on the information presented to them. 2) Grading issues along that curve require a retaining wall where the utility easement typically would be located. 3) There will not be any homes constructed in that area. Engineering regarding "that funny little road" in the NE corner of the property that provided access to the mobile home that has been removed. I concur with you that this "road" has not been dedicated to either the city or the county. I doubt, as you suspect, that this road is owned by New Mercer Ditch. The only relationship it has to the ditch is that it veers off from the ditch road. This is a very unusual situation in that the portion of the ditch road between W. Vine and the Bellwether Farm property has become New Mercer Drive in the County. My guess and that of Stewart Surveying is that for years this property was considered by the county to have public access from New Mercer Drive that dead ends at the property. The "road" on the property is simply a long driveway beginning at the end of New Mercer Drive and having provided access to the removed mobile home. There would be absolutely no use for this "road" by the ditch company, in this "road" does not parallel the ditch, but rather veers off from the ditch road. This is not a "road" but a driveway, with no public dedication and never having been used by the ditch company. I suggest that we include the vacation of any access road on the property within the standard note on the plat addressing the vacation of other unnecessary easements, including the gas line easement. We currently are in the preliminary design phase for improvements to Taft Hill Rd from Laporte Avenue north to the Poudre River. As part of our project, it is our plan to improve the intersection of Taft Hill and Vine Drive. These intersection improvements will extend west on Vine Drive to the existing structure over the New Mercer Canal. Per Kyle's and my discussions with you, it is our understanding that the proposed Bellwether development is being required to improve Vine Drive from N. Briarwood Road east to Taft Hill to a minimum of 36' wide paved roadway. We are willing to commit to making these improvements from N. Briarwood Rd to Taft Hill as part of our project, rather than the developer making the improvements, with the following understanding: • The developer will pay to Larimer County the amount necessary to make the improvements from N Briarwood to the New Mercer Canal. The developer's engineer will provide the County with a design and a cost estimate that we will need to approve for this to happen. • The developer will provide any and all design information that they have for this section of Vine Drive in an electronic format acceptable to the County. In return, the County will commit to making the improvements to Vine Drive by the end of the construction season in 2008 regardless if our currently planned improvement project moves forward or not.
