Dear Ms. Wamhoff:
The following is a request for variance from the Table 7-1 — General Parameters — Curb &
Gutter Vertical in the "Larimer County Urban Area Street Standards, October, 2002". This
variance is requested to allow the curb to be eliminated on the north side of Buckingham Street
for approximately 800 feet. Buckingham is a minor collector street with parking.
Buckingham is proposed to be improved to the collector standard for approximately 1700' from
the intersection with 1 s` Street to the east. Drive over curb with attached sidewalk exists along the
south side of Buckingham from I" Street to 3rd Street. Approximately 200' of vertical curb with
attached sidewalk exists on the south side of Buckingham east of the proposed improvement. The
remainder of Buckingham currently has a rural type section with shoulders and a borrow ditch.
It is proposed to construct Buckingham to the collector standard width and accommodate all of
the required lanes. In place of the vertical curb, it is proposed to install a 30" wide concrete edge
to prevent the asphalt from raveling and define the street edge. Since there will be parking along
this edge, this parking aisle and the bike lane will provide a 14' recovery area if a vehicle
inadvertently leaves the designated through lane.
A bio Swale will be constructed in the parkway and a walk will be constructed north of the bio
swale. The parkway will be widened to 10' to accommodate the bioswale and the required street
trees. The walk is also being widened to 8'. The swale will be approximately 1' deep and will be
used to convey runoff from the street east to the intersection of Buckingham and Lemay Avenue.
This swale will also provide a water quality component that will help remove pollutants and
particulates from the street runoff prior to the runoff entering the storm system and the Poudre
River. This swale will not be used to treat any runoff other than the street and sidewalk. Any
other development would be required to provide its own water quality component prior to
discharge into the storm system.
The bioswale will be lined with approximately 10" to 12" of sandy soil to promote percolation of
the runoff water into the soil. The swale will also be landscaped with low maintenance plantings

Dorothy Whislcr regarding the Coy Ditch I have spoken with the Wltialcrs and the Hoffmaas
regarding your request My clients arc concerned regarding the affect the enclosed culvert may
have upon the flaw of water in the ditch. They also want to ensure any documc nation regarding
the ditch easement is reviewed by their water attorney. Thus, they will retain Tutdc Applegate, a
water engineering firm, and Peggy Montana, Esq. of 1'rout, Raicy, Montana, Witwcr & Freeman
to Overscc their interests. In order to cover the costs for these consultants and to consent to this

Attached is information that Kim Jordan submitted to Don,
per our request that they work on an agreement with the
Ditch that they would be okay with future realignment of
the ditch. Don is out the rest of this week and he asked me
to forward this onto you for your review and comments.
We had meet a couple of weeks ago to talk about what we
would need to get from New Belgium and the Ditch
Company to be comfortable that we would not have any
problems with relocating the ditch in the future even
though they do not want to provide what they consider a
final design at this time.
Does this get us close to what we need and what you were
expecting?

Dear Rick,
Per -our phone conversation In December, New Belgium Brewing Company is asking
your permission to proceed with under grounding a portion of the Coy Ditch
currently located in the City of Fort Collins Right of Way along Buckingham Street.
Attached are one copy of the existing conditions and one preliminary design
drawing.
The reason we are requesting this is to accommodate the City's requirements
for widening of adjacent Buckinghama Street to Larimer County Standards, which
would move the Right of Way line further north into our property.. In order to meet
these standards, the ditch would.also have to move north, onto our property, which
is why we would need to pipe It and grant an easement to the owners,
The City of Fort Collins requires us to have a signed letter from all the owners (by
February 2 for a scheduled hearing) stating that they are in agreement with the
direction we are heading. Assuming all the owners are In agreement, we would.
follow up with a new legal description (to go on record), that reflects the changes
upon final design.

Because of the recovery area provided by the bike and parking lanes, the safety of the driver is
addressed. The bio swale provides a physical barrier to address the safety of the pedestrian if a
vehicle is able to leave the paved surface. This variance from the above Standards will not be
detrimental to the public health, safety and welfare.

Coy Ditch as it runs in a pipe from 1" Street east to 3td Street and south across Buckingham
Street into a new easement on the property of New Belgium adjacent to the north side of
Buckingham Street. You have been asked to obtain preliminary approval and consent from the

Dear Ms. Wamhoff:
The following is a request for variance from Section 7.4.1.B.1. — General Design Elements —
Minimum Flowline Grade in the "Larimer County Urban Area Street Standards, March 2001".
This variance is requested to allow portions of Buckingham Street to be designed and constructed
with grades varying from 0.4% to 0.5%.
In the past, the minimum grade allowed was 0.4%. Portions of the south side of Buckingham
were constructed or below at this grade. This project will widen the road to the north and will
need to match the existing grade in order to avoid complete reconstruction of the roadway. Other
possible solutions would require multiple low points and compromise the ride ability of the north
half of the street.
This variance from the above Standards will not be detrimental to the public health, safety and
welfare.

RE: New Belgium Brewery Street Slope Variance Request
Dear Ms. Kroetch:
The City Engineer has evaluated your letter "New Belgium Brewery — Request for
Variance 2 — Street Slope" dated July 28, 2005 and the accompanying design illustrated
on the "Public Improvement Plans for Buckingham Street'. Based upon this analysis, it
was concluded that the variance request can be supported and was approved on this date,
September 8, 2005.
While the request was granted to reduce the minimum grade to .4%, this should not be
viewed as a precedent for future designs not meeting the .5% requirement. Please let me
know of any questions or concerns.

RE: New Belgium Brewery Curb and Gutter Variance Request
Dear Ms. Kroetch:
The City Engineer has evaluated your letter "New Belgium Brewery — Request for
Variance 1 — Curb" dated July 28, 2005 and the accompanying design illustrated on the
"Public Improvement Plans for Buckingham Street". Based upon this analysis, it was
concluded that the variance request cannot be supported and was denied on this date,
September 9, 2005.
While we in Transportation Services desire to be open to design concepts that may be
viewed as innovative in realms outside of transportation, we are still wanting to be
mindful of how these alternative concepts impact transportation needs. In general, the
City Engineer expressed concern on the increased maintenance responsibility
Transportation Services foresees in allowing water to collect and infiltrate in close
proximity to the pavement subgrade. In this scenario, the life of the street will be reduced
from a typical curb and gutter street section where water is directed away from the
surrounding street. We are faced with ongoing pavement management issues on our
public street system at large and a tightening budget to handle this responsibility; to
introduce this alternative cross section, we believe would not be in keeping with the
welfare of the general public.

Re: Request for Variance #1 —Narrow street section

Dear Marc
The following is a request for variance from Table 7-1 — Roadway Width in the "Larimer
County Urban Area Street Standards, March 2001". This variance is requested to allow
bumpouts on the north side of Buckingham Street (a minor collector with parking) which will
narrow the street width in the area of the bumpout.
The bumpout will cause the street to be 42' wide for a distance of approximately 80'. In this
area, parking will not be allowed. The narrower street will still allow for two 12' drive lanes and
the required bike lanes therefore traffic will not be impeded. This bumpout will also define the
parking areas and will help to control driving speeds on Buckingham Street.
This variance from the above Standards will not be detrimental to the public health, safety and

Thanks Marc - looks pretty straight forward - a couple of questions.
1) There are some existing hydrants that need to be relocated - I
assume the new lines and hydrants need to be included in the counts.
2) Trenching means all excavations for Sanitary and Water from the
street taps to onsite within 5' of the building? Is the storm that feeds
into the onsite detention ponds considered private? or does this, as well as
anything that is in the public right of way for the storm line need to be
included with the calculations?
3) Do any items in the deferred improvements agreement for Buckingham
and the future storm line down 1st street need to be included in this DCP?
4) If #3 above is no I assume that street patches and minor curb repair
is all that would need to be included for the remaining work.
5) The West entry off of Linden is being widened - I assume the
sidewalk, curb cut and C&G up to the City easement needs to be included?
6) The Water meter pit is noted as V on the spreadsheet - we have a 2"
does this change anyting fee wise?
7) IF #3 above is yes - does the COY Ditch need to be included?
8) There are some existing storm lines that will be abandoned and flow
filled - do they then need to be included in the calculation?
9) We may need to lower the 24" NWCWD main that runs down Buckingham -
does this need to be included in the calcs?
Sorry - didn't realize I had some many questions till I got looking at
things. Any help with these would be greatly appreciated.
