Reference: Colony @ Rigden Farm — Variance request for street intersection offset.
Dear Ms. Moore:
The intent of this letter is to request a variance for the offset in alignment of Kansas Drive at
Custer Avenue. The distance between the Kansas center line north of Custer and the Kansas
centerline south of Custer is approximately 75 feet. This offset is greater than the distance
allowed by the "Larimer County Urban Area Street Standards, January 2, 2001" edition. This
standard is found in Table 7-3 on Page 7-7 of the design criteria.
Support for the variance described above is discussed in the line items listed below:
1) The geometry of the Kansas alignment creates a hardship in developing the property.
The City code requires minimum radii and tangents that when used to design Kansas
create a parcel that is practically undevelopable.
2) Unlike many offset intersections that create traffic congestion and can have conflicting
left turn movements, creating a situation that is unsafe. This street offset does not
have conflicting left turn movements. Also it should be noted that Custer Avenue is a
Collector and not an Arterial, and is signalized at Timberline. The majority of the
traffic from Kansas will turn onto Custer toward Timberline and not proceed through
Custer.
3) Kansas has a short extension to the south before is transitions easterly and ties back
into Willow Tree to the east. Since there are multiple outlets and the length of Kansas
south of Custer is relatively short traffic will be minimal.
Therefore, it is not anticipated that any public health, safety, and/or welfare problems will be
created by the varied design. If you have any questions or comments, or need additional

reverse curve is required. The City code requires minimum radii and tangents with such
curves and tangents that create an unusual shaped parcel that is difficult to design within.
2) Unlike many offset intersections that create traffic congestion and can have conflicting left
turn movements, creating a situation that is unsafe. This street offset does not have
conflicting left turn movements. Also it should be noted that Custer Avenue is a Collector
and not an Arterial, and is signalized at Timberline. The majority of the traffic from Kansas

Re: The Colony at Rigden Farm — Request for Variance for Off Street Parking Setback
Dear Don:
Please consider this as the Variance Request for the off street parking setback for the two on site
driveways. In particular, we request a variance to reduce the 40 foot minimum setback (required
for 100-750 ADT for local streets) to accommodate a minimum distance of 20 feet. This item is
found in Section 9.4.12, ';'Minimum Off -Street Parking Setback Distance" and drawing 19-06 of
the Larimer County Urban Area Street Standards.
The ADT for the westerly parking lot is approximately 77 ADT from the 24 parking spaces. Of
these 77 ADT's approximately 7 will be generated during the pm peak hour and 6 during the am
peak hour. The ADT for the easterly parking lot is approximately 157 ADT from the 49 parking
spaces. Of these 157 ADT's approximately 14 will be generated during the pm peak hour and 12
during the am peak hour. The 20 foot setback combined with the setback for onstreet parking,
one to two cars could possibly queue without blocking the Kansas thru lane. Therefore, due to
the limited number of peak hour trips and the provided queue length, the life safety is not viewed
as an issue. It should also be noted that the driveways will be personal to the families that live
there. They will be familiar with their surroundings and be more cautious in their maneuvers
than normally found in a public parking lot. This provides for added safety and reinforces the
minimal impact to life safety. The geometry of all of the current off street setback lanes (to
driveway areas) allows adequate sight distance and vehicle movement. It is not anticipated that
the proposed setback lengths pose a threat to public health or welfare.
