Dear Mr. Preiss, This letter is in response to your request for the City to use the cash escrow you provided to the City in October 2005 for the easement you need across Lotl, Preiss Subdivision for your development on Lot 2, Preiss Subdivision. The intent of providing this escrow with the City was to provide you with time to work on obtaining this easement while providing the City with assurance that you would continue to work on this. Per City Resolution 2001-40 a developer must work on obtaining the easements necessary for their development first and if unable to do so and can provide proof of the failed efforts to the City and then the City would possibly work toward obtaining the easement at the Developers cost. It should be noted that if we reach this situation and the amount of the escrow already received is not adequate to cover the costs you will be responsible for any additional costs to process and obtain the easement. The certificate of occupancy (CO) for the new house on Lot 2 will not be issued until such a time as the dedication for the easement referenced above has been provided to the City in acceptable format and any fees and recording costs for processing the document have been provided. A new Transportation Development Review Fee was implemented in January and a processing fee of $250 will apply to this dedication.
