DEED OF DEDICATION FOR EASEMENT
KNOW ALI, MEN BY THESE PRESENTS: That the undersigned, Bachmann
Enterprises, LLC, a Colorado limited liability company, being the owner of certain real property in
Latimer County, Colorado legally described as the North half ofLot 5, Block 173 in the City of Fort
Collins, Colorado, in consideration of Ten Dollars (S10.00) in hand paid, receipt of which is hereby
acknowledged, and ether good and valuable consideration, does hereby dedicate, transfer, and
convey to the City of Fort Collins, Colorado, a Municipal Corporation, for public use forever a
permanent casement for utilities in the Citv of Fort Collins. Countv of Larimer, State of Colorado,
more particularly described on Exhibit "A" attached hereto and by this reference made apart hereof.
It is understood by the undersigned that, by acceptance of this dedication, the City of Fort
Collins will not accept the duty of maintenance of such easement.

required pursuant to Section 2.2.3 (C)(3)(a) through (e) inclusive of the Land Use Code of the. City of
Fort Collins and that all persons signing this Deed on behalf of a corporation or other entity are duly
authorized signatories under the laws of the State of Colorado. This Certification is based upon an
examination of the records of the Clerk and Recorder of Larimer County, Colorado as of the date of
execution of the deed and other information discovered by me through reasonable inquiry and is
limited as authorized by Section 2.2.3( _ ) of the Land Use Code.

DESCRIPTION: Utility Easement
A utility easement being a portion of the North Half of Lot 5, Block 173 in the City of
Fort Collins, described at Reception No. 2004-0054579, County of Larimer, State of
Colorado, being more particularly described as follows:
Considering the North line of said Lot 5, Block 173 as bearing South 89°49' 19" East and
with all the bearings contained herein relative thereto:
BEGINNING at the Northwest corner of said Lot 5, Block 173; thence along the North
line of said Lot 5, Block 173. South 89°49' 19" East, 190.02 feet to the Northeast comer
of said [,ot 5; thence along the East line of said Lot 5, South 00°08'46" West, 49.87 feet
to the Southeast corner of the North Half of said Lot 5; thence along the South line of the
North Half of said Lot 5, North 89°54'02" West, 4.00 feet; thence, North 00008'46"
East, 45.87 feet; thence, North 89°49'19" West, 180.02 feet; thence, South 00007'29"
West, 46.12 feet to a point on the South line of the North Half of said Lot 5; thence along
said South line, North 89°54'02" West, 6.00 feet to the Southwest corner of the North
