Solar Orientation of Lots

The applicant, Postle Development, is requesting a Modification of Standards for the
required percentage of solar oriented lots within a proposed development located on the northeast
corner of E. Drake and S. Timberline Roads.
Section 3.2.3 (B) of the Fort Collins Land Use Code states that "At least sixty-five (65)
percent of the lots less than fifteen thousand (15,000) square feet in area in single- and two-family
residential developments must conform to the definition of a "solar -oriented lot" in order to preserve
the potential for solar energy usage."
The definition of a "solar -oriented lot" per Section 5.1.2 of the Fort Collins Land Use Code is
(1) A lot with a front lot line oriented to within thirty (30) degrees of a true east -west line.
When the lot line abutting a street is curved, the "front lot line" shall mean the chord or
straight line connecting the ends of the curve. For a flag lot, the "front lot line" shall mean
the lot line that is most parallel to the closest street, excluding the "pole portion of the flag
lot"; or
(2) A lot which, when a straight line is drawn from a point midway between the side lot lines
at the required front yard setback to a point midway between the side lot lines at the
required rear yard setback, is oriented to within thirty (30) degrees of true north along said
line; or
(3) A corner lot with a south lot line oriented to within thirty (30) degrees of a true east -west
line, which south lot line adjoins a public street or permanently reserved open space;
provided, however, that the adjacent street right-of-way or open space has a minimum
north -south dimension of at least fifty (50) feet. For the purposes of this definition,
"permanently reserved open space" shall include, without limitation, parks, cemeteries, golf
courses and other similar outdoor recreation areas, drainage ditches and ponds, irrigation
ditches and reservoirs, lakes, ponds, wetlands, open spaces reserved on plats for
neighborhood use and other like and similar permanent open space.
The applicant is requesting a reduction in the percentage of solar oriented lots. Current
standards require that 65% of the single-family dwelling units be solar oriented. The applicant is
requesting that 183 of the 428 dwelling units be solar oriented. This would allow for 43%of the total
dwelling units in SideHill Filing 2 to be solar oriented. The basis for the modification request is cited
below.
Based on the Land Use Code, Section 3.2.3 (E), the applicant maintains the proposed
decrease in percentage of lots that are not solar oriented is not detrimental to the public good and
promotes the general purpose of the standard equally as well or better than a plan that complies
with the standards.

Dear Mr. Postle,
This letter is a follow up to our discussion on Friday regarding the infrastructure warrantee that
the City does not have for completed and accepted improvements in Sidehill 2"' Filing.
Development Construction Permits (DCP) were issued for what was originally Sidehill 2"' Filing
Phases to and 18. After construction started, phase 1B was rephased into Phases 1 B, 1C and
1D. Somehow thru this confusion the letters of credit that were provided for the infrastructure
security were released even though 25% should have been held thru the warrantee period in
accordance with Section 3.3.2(C) of the Land Use Code.
We do have a letter of credit that was originally provided to cover all of the infrastructure work
for the original overall Phase 1B, but it was reduced over time and now only totals $277,690,
which is the full amount for the remaining work to be done in Phase 1 D (letter of credit #3688).
This amount though does not provide the required two year 25% security for the infrastructure
that has been installed in the 2"' Filing.
Therefore we are asking that a letter of credit be provided for 1 year (the amount of time
remaining on the two year secured warrantee) for the maintenance and repair of the public
infrastructure that has been constructed and accepted in Phases 1A, 1B, I and I (only the
wet utilities have been built and constructed in Phase 1D). The amount of the letter of credit
needed is 1454,443.00 (this is 25% of the original total amount of $1,817,775). 1 have attached
copies of the cost estimates that were provided to us by your engineer for reference. Please
provide the letter of credit prior to July 13, 2007,
