Dear Mike:
This is to request that you initiate the vacation of a 24.00 foot wide
access, drainage and utility easement and a drainage easement and a part
of a power easement situate in Lot 3, Prospect/Overland P.U.D. The site
plan has been revised with a different configuration of the storage
buildings which has necessitated this vacation.
The legal description of the vacated easements and a plat delineating
them are enclosed.
I would appreciate your attention to this matter as soon as possible
because the first building has been completed and another is going to
start very soon. The vacation was overlooked by Dick Rutherford.

OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF EASEMENTS ON LOT 3, OF
PROSPECT/OVERLAND P.U.D.
WHEREAS, Section 2-353(4) of the Code of the City of Fort Collins
authorizes the Planning and Zoning Board to vacate certain easements and
rights -of -way, by resolution or by approval of replats containing notation of
such vacation; and
WHEREAS, the owner of Lot 3, of Prospect/Overland P.U.D., City of Fort
Collins, Larimer County, Colorado, has requested the vacation of portions of
access, drainage, utility and power easements on said Lot 3; and
WHEREAS, the City utilities and private utilities have been contacted and
express no objection to the proposed vacation.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of
the City of Fort Collins that the portions of the access, drainage, utility and
power easements, more particularly described on the attached Exhibit "A," are
hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning
Board of the City of Fort Collins held this 27th day of March, A.D. 1989.

EXHIBIT "A"
24 FOOT ACCESS DRAINAGE AND UTILITY EASEMENT TO BE VACATED: A part of
a 24.00 foot access, drainage and utility easement situate in Lot 3,
Prospect/Overland-P.U.D., City of Fort Collins, County of Larimer, State
of Colorado, which is contained within the boundary lines which begin
at a point which bears N 00' 35' W 15.00 feet, and again N 89° 42' E
8.00 feet from the Southwest conrer of said Lot 3, and run thence N 00°
35' W 24.00 feet; thence N 89' 42' E 100.98 feet; thence along the arc
of a 25.00 foot radius curve to the left a distance of 23.45 feet, the
long chord of which bears N 62° 49' 30" E 22.60 feet; thence N 350 57'
E 246.70 feet; thence along the arc of a 25.00 foot radius curve to the
left a distance of 15.94 feet, the long chord of which bears N 17° 41'
E 15.67 feet; thence N 00' 35' W 43.60 feet to a point on the Northerly
boundary line of said Lot 3; thence along said boundary line East 15.48
feet and again S 54° 03' E 10.61 feet; thence S 00' 35' E 53.31 feet;
thence S 35' 57' W 287.70 feet; thence S 89° 42' W 125.69 feet to the
point of beginning, containing 10,876 square feet more or less.
DRAINAGE EASEMENT TO BE VACATED: A 10.00 foot wide drainage easement
situate in Lot 3, Prospect/Overland-P.U.D., City of Fort Collins, County
of Larimer, State of Colorado, which begins at a point which bears S
00° 35' E 139.00 feet and again N 89° 25' E 8.00 feet from the Northwest
corner of said Lot 3 and run thence N 89° 25' E 57.00 feet; thence S
00* 35' E 10.00 feet; thence S 89' 25' W 57.00 feet; thence N 00' 35'
W 10.00 feet to the point of beginning.
POWER EASEMENT TO BE VACATED: A part of a power easement situate in
Lot 3, Prospect/Overland-P.U.D., City of Fort Collins, County of Larimer,
State of Colorado, which begins at a point which bears S 89' 41' E 105.00
feet and again S 00° 35' E 3.00 feet from the Northwest corner of said
Lot 3 and run thence S 89' 41' E 65.00 feet; thence S 00' 35' E 4.00
feet; thence N 89' 41' W 65.00 feet; thence N 00' 35' W 4.00 feet to
the point of beginning.
