RE: Improvements to JFK Parkway

As a part of the development at your Fort Collins store, Shopko was required to construct a
portion of JFK Parkway adjacent to your site.
Because of other planned projects in the immediate area, the City requests that you do not
install the top 1 1/2" lift of asphalt to complete JFK adjacent to your site. The City intends to
complete the connection of JFK Parkway to Horsetooth Road in 1994. The City believes a
much better roadway can be obtained by a continuous overlay of the final lift on both projects
at that time.
In accordance with the development agreement, the City will reimburse for street oversizing of
JFK Parkway. The amount of reimbursement will be adjusted for this change in construction.

Dear Mr. Herzig:
Attached is our Opinion of Cost of the street oversizing on JFK Parkway and for 3 feet of
the 7-foot sidewalk adjacent to College Avenue. This cost estimate should replace the
estimate which was faxed to you earlier today. The earlier estimate only included
improvements east of the centerline of JFK Parkway. This estimate includes all asphalt
beyond the developers 12-foot required pavement section.
I hope this does not create too much confusion and I apologize for the earlier estimates
incompleteness, I misunderstood Steve Boyette's request. If you have any questions, please
feel free to contact me.

Muddy Road Vacation
We hereby give our permission to Rosenbaum and Dean and the City of
ForL Collins to proceed to hear a Second and Final Reading at City
Council on June 1, 1993 on the matter to vacate a portion of Muddy
Ruad adjacent to land which we own.
We are in favor of vacating Muddy Road as it relates to this
particular PUD and reserve the right to discontinue the vacation of
Muddy Road in the event we do not transfer title to the property by
June 1, 1993.

Dear Kerrie/Mike:
While reviewing your comments from our first submittal of the Final Plans for the ShopKo
P.U.D., we noticed your request to see our design calculations for the retaining wall near
the east pond. We are sending you the output files generated by the software we used to
design the walls. The program used is called "Retain Pro" and was developed by Enercalc.
The soils information we used was taken from the soils report prepared by Empire
Laboratories in December of 1992. Information about the footings for the ShopKo building
(i.e. their design bearing stress) was provided by ShopKo's structural engineer in Minnesota.
